  2016年推進簡(jian)政放(fang)權(quan)放(fang)管結合(he)優化服務改革工作(zuo)要點

  2016年(nian)是“十(shi)(shi)三五(wu)”規劃開局之年(nian),也(ye)是推進(jin)供給側結(jie)構性(xing)改革(ge)的(de)攻堅之年(nian)。今年(nian)推進(jin)簡政(zheng)(zheng)放權、放管結(jie)合、優化(hua)服(fu)務改革(ge)的(de)總體要求是:全面貫徹黨(dang)的(de)十(shi)(shi)八大(da)和十(shi)(shi)八屆二中、三中、四(si)中、五(wu)中全會精神(shen),認(ren)真落實中央經濟(ji)工(gong)作(zuo)會議和《政(zheng)(zheng)府工(gong)作(zuo)報告》部署,按照(zhao)創(chuang)(chuang)新、協調、綠色、開放、共享的(de)發展(zhan)理(li)念(nian),緊緊扭住轉變政(zheng)(zheng)府職能這個“牛鼻子”,在(zai)(zai)更(geng)大(da)范圍、更(geng)深(shen)層次,以更(geng)有力(li)舉措推進(jin)簡政(zheng)(zheng)放權、放管結(jie)合、優化(hua)服(fu)務改革(ge),使市場(chang)在(zai)(zai)資源(yuan)配置中起決定(ding)性(xing)作(zuo)用(yong)(yong)和更(geng)好(hao)發揮政(zheng)(zheng)府作(zuo)用(yong)(yong),破除(chu)制(zhi)約企業和群眾(zhong)辦(ban)事創(chuang)(chuang)業的(de)體制(zhi)機制(zhi)障礙,著力(li)降(jiang)低(di)制(zhi)度性(xing)交易成(cheng)本(ben),優化(hua)營商(shang)環(huan)境,激發市場(chang)活(huo)力(li)和社(she)(she)會創(chuang)(chuang)造力(li),與大(da)眾(zhong)創(chuang)(chuang)業、萬眾(zhong)創(chuang)(chuang)新和發展(zhan)壯大(da)新經濟(ji)緊密結(jie)合起來,進(jin)一步形成(cheng)經濟(ji)增長內生(sheng)動力(li),促進(jin)經濟(ji)社(she)(she)會持(chi)續健康(kang)發展(zhan)。

  一、持續簡政放權,進一步激(ji)發市場活力和社會創造(zao)力

  (一(yi)(yi))繼續(xu)(xu)深化(hua)(hua)行(xing)政審(shen)(shen)(shen)批(pi)改(gai)革。繼續(xu)(xu)加大放權(quan)(quan)力度,把(ba)該(gai)放的(de)權(quan)(quan)力放出去(qu),能(neng)取(qu)(qu)消的(de)要盡(jin)量取(qu)(qu)消,直接(jie)放給市場和(he)(he)社(she)會。今年要再取(qu)(qu)消50項(xiang)(xiang)(xiang)以(yi)上(shang)國(guo)務院(yuan)部(bu)門(men)行(xing)政審(shen)(shen)(shen)批(pi)事(shi)(shi)(shi)項(xiang)(xiang)(xiang)和(he)(he)中央指(zhi)定地(di)方(fang)實施的(de)行(xing)政審(shen)(shen)(shen)批(pi)事(shi)(shi)(shi)項(xiang)(xiang)(xiang),再取(qu)(qu)消一(yi)(yi)批(pi)國(guo)務院(yuan)部(bu)門(men)行(xing)政審(shen)(shen)(shen)批(pi)中介服務事(shi)(shi)(shi)項(xiang)(xiang)(xiang),削減一(yi)(yi)批(pi)生(sheng)產許(xu)可(ke)(ke)證、經營(ying)許(xu)可(ke)(ke)證。對(dui)確(que)需(xu)(xu)下放給基(ji)層(ceng)的(de)審(shen)(shen)(shen)批(pi)事(shi)(shi)(shi)項(xiang)(xiang)(xiang),要在人才、經費、技術、裝備等方(fang)面予(yu)以(yi)保(bao)(bao)(bao)障,確(que)保(bao)(bao)(bao)基(ji)層(ceng)接(jie)得住、管得好。對(dui)相同、相近或(huo)相關聯的(de)審(shen)(shen)(shen)批(pi)事(shi)(shi)(shi)項(xiang)(xiang)(xiang),要一(yi)(yi)并取(qu)(qu)消或(huo)下放,提高放權(quan)(quan)的(de)協同性(xing)、聯動(dong)性(xing)。對(dui)確(que)需(xu)(xu)保(bao)(bao)(bao)留(liu)的(de)行(xing)政審(shen)(shen)(shen)批(pi)事(shi)(shi)(shi)項(xiang)(xiang)(xiang),要統一(yi)(yi)審(shen)(shen)(shen)批(pi)標準,簡化(hua)(hua)審(shen)(shen)(shen)批(pi)手續(xu)(xu),規范審(shen)(shen)(shen)批(pi)流程。所有(you)行(xing)政審(shen)(shen)(shen)批(pi)事(shi)(shi)(shi)項(xiang)(xiang)(xiang)都要嚴格按(an)法(fa)定時限做(zuo)到(dao)“零超時”。繼續(xu)(xu)開(kai)展相對(dui)集中行(xing)政許(xu)可(ke)(ke)權(quan)(quan)改(gai)革試點(dian),推廣地(di)方(fang)實施綜合(he)審(shen)(shen)(shen)批(pi)的(de)經驗。(國(guo)務院(yuan)審(shen)(shen)(shen)改(gai)辦(ban)牽頭,國(guo)務院(yuan)各(ge)有(you)關部(bu)門(men)按(an)職責(ze)分工負責(ze))

  (二)深入推(tui)進(jin)投資(zi)(zi)(zi)審(shen)批(pi)改(gai)革。進(jin)一步擴大(da)企(qi)業自(zi)主權,再修訂政(zheng)(zheng)府(fu)核準(zhun)的投資(zi)(zi)(zi)項目(mu)(mu)(mu)目(mu)(mu)(mu)錄,中(zhong)央(yang)政(zheng)(zheng)府(fu)層面核準(zhun)的企(qi)業投資(zi)(zi)(zi)項目(mu)(mu)(mu)削減比例累計達到原總量的90%以上。出臺(tai)《企(qi)業投資(zi)(zi)(zi)項目(mu)(mu)(mu)核準(zhun)和備案(an)管理(li)條例》。制(zhi)定中(zhong)央(yang)預算(suan)內投資(zi)(zi)(zi)審(shen)批(pi)制(zhi)度改(gai)革方(fang)(fang)案(an)。出臺(tai)整(zheng)合規(gui)范投資(zi)(zi)(zi)建(jian)設項目(mu)(mu)(mu)報建(jian)審(shen)批(pi)事項實施方(fang)(fang)案(an)。保留的投資(zi)(zi)(zi)項目(mu)(mu)(mu)審(shen)批(pi)事項要全部(bu)(bu)(bu)納入全國(guo)統一的投資(zi)(zi)(zi)項目(mu)(mu)(mu)在線(xian)審(shen)批(pi)監(jian)管平臺(tai),實行“一站式(shi)”網(wang)上審(shen)批(pi),大(da)幅縮短(duan)審(shen)批(pi)流程和審(shen)批(pi)時間,推(tui)進(jin)投資(zi)(zi)(zi)審(shen)批(pi)提(ti)速。(國(guo)家發(fa)展改(gai)革委牽頭,國(guo)土資(zi)(zi)(zi)源部(bu)(bu)(bu)、環境保護部(bu)(bu)(bu)、住房城(cheng)鄉建(jian)設部(bu)(bu)(bu)、交通運輸(shu)部(bu)(bu)(bu)、水利部(bu)(bu)(bu)、國(guo)務院法(fa)制(zhi)辦(ban)等(deng)相關部(bu)(bu)(bu)門按職責(ze)分工(gong)負責(ze))

  (三(san))扎實做好職(zhi)(zhi)業(ye)資(zi)(zi)(zi)格(ge)(ge)改革。再取(qu)消一(yi)(yi)批職(zhi)(zhi)業(ye)資(zi)(zi)(zi)格(ge)(ge)許(xu)可(ke)和認(ren)定事項,國(guo)(guo)務院(yuan)(yuan)部(bu)門設(she)置(zhi)的(de)(de)(de)職(zhi)(zhi)業(ye)資(zi)(zi)(zi)格(ge)(ge)削(xue)減比例達到(dao)原總量(liang)的(de)(de)(de)70%以(yi)上。全面清理(li)名目繁多的(de)(de)(de)各種(zhong)行業(ye)準(zhun)入證、上崗證等(deng),不(bu)合理(li)的(de)(de)(de)要堅決取(qu)消或整合。建(jian)立國(guo)(guo)家(jia)職(zhi)(zhi)業(ye)資(zi)(zi)(zi)格(ge)(ge)目錄清單管理(li)制度,清單之外一(yi)(yi)律(lv)不(bu)得開展職(zhi)(zhi)業(ye)資(zi)(zi)(zi)格(ge)(ge)許(xu)可(ke)和認(ren)定工作(zuo),清單之內(nei)除準(zhun)入類職(zhi)(zhi)業(ye)資(zi)(zi)(zi)格(ge)(ge)外一(yi)(yi)律(lv)不(bu)得與就業(ye)創業(ye)掛鉤。嚴肅查處職(zhi)(zhi)業(ye)資(zi)(zi)(zi)格(ge)(ge)“掛證”、“助考”等(deng)行為,嚴格(ge)(ge)落實考培分(fen)離。(人力資(zi)(zi)(zi)源社會保障部(bu)牽(qian)頭,工業(ye)和信息(xi)化部(bu)、住房城鄉建(jian)設(she)部(bu)、交(jiao)通運輸部(bu)、國(guo)(guo)務院(yuan)(yuan)國(guo)(guo)資(zi)(zi)(zi)委、質檢總局(ju)、安全監(jian)管總局(ju)、食品藥品監(jian)管總局(ju)等(deng)相關部(bu)門按(an)職(zhi)(zhi)責分(fen)工負責)

  (四)持(chi)續(xu)推進(jin)(jin)商(shang)(shang)事(shi)制(zhi)(zhi)度改革。進(jin)(jin)一(yi)(yi)步(bu)(bu)放寬(kuan)市場準(zhun)入,繼續(xu)大力削(xue)減工(gong)商(shang)(shang)登(deng)(deng)記(ji)前(qian)置(zhi)審(shen)批(pi)事(shi)項(xiang),今年再(zai)取消三(san)分之一(yi)(yi),削(xue)減比例達到原總(zong)量的90%以上,同步(bu)(bu)取消后(hou)置(zhi)審(shen)批(pi)事(shi)項(xiang)50項(xiang)以上。在全(quan)面(mian)(mian)實(shi)施企業“三(san)證(zheng)(zheng)(zheng)合一(yi)(yi)”基礎上,再(zai)整合社會(hui)保險登(deng)(deng)記(ji)證(zheng)(zheng)(zheng)和(he)統(tong)計登(deng)(deng)記(ji)證(zheng)(zheng)(zheng),實(shi)現“五證(zheng)(zheng)(zheng)合一(yi)(yi)、一(yi)(yi)照(zhao)一(yi)(yi)碼”,降低創業準(zhun)入的制(zhi)(zhi)度成本。擴大“三(san)證(zheng)(zheng)(zheng)合一(yi)(yi)”覆蓋面(mian)(mian),推進(jin)(jin)整合個體工(gong)商(shang)(shang)戶營業執(zhi)照(zhao)和(he)稅(shui)務(wu)(wu)(wu)登(deng)(deng)記(ji)證(zheng)(zheng)(zheng),實(shi)現只需(xu)填(tian)寫“一(yi)(yi)張表”、向“一(yi)(yi)個窗口(kou)”提交“一(yi)(yi)套材料”,即可辦(ban)理工(gong)商(shang)(shang)及稅(shui)務(wu)(wu)(wu)登(deng)(deng)記(ji)。加快推進(jin)(jin)工(gong)商(shang)(shang)登(deng)(deng)記(ji)全(quan)程(cheng)電子化(hua)、名稱登(deng)(deng)記(ji)、放寬(kuan)住所條(tiao)件、簡(jian)易注(zhu)銷登(deng)(deng)記(ji)等(deng)(deng)改革試(shi)點。加快推行電子營業執(zhi)照(zhao)。抓(zhua)好“證(zheng)(zheng)(zheng)照(zhao)分離”改革試(shi)點,切實(shi)減少各種不必要的證(zheng)(zheng)(zheng),解(jie)決企業“準(zhun)入不準(zhun)營”的問題,盡快總(zong)結(jie)形成可復制(zhi)(zhi)、可推廣的經驗。(工(gong)商(shang)(shang)總(zong)局(ju)、國務(wu)(wu)(wu)院(yuan)審(shen)改辦(ban)牽頭,人(ren)力資源(yuan)社會(hui)保障部、稅(shui)務(wu)(wu)(wu)總(zong)局(ju)、國務(wu)(wu)(wu)院(yuan)法制(zhi)(zhi)辦(ban)、國家統(tong)計局(ju)等(deng)(deng)相關部門(men)和(he)上海(hai)市人(ren)民政(zheng)府(fu)按職責分工(gong)負責)

  (五)積(ji)極開展收費(fei)清理改(gai)革和監督檢查。嚴格落實已出(chu)臺的各項收費清理政策(ce),防止反彈或(huo)變相(xiang)收費。全面(mian)清(qing)理和整(zheng)合規(gui)范各(ge)(ge)類認證、評(ping)估、檢(jian)查、檢(jian)測(ce)等中介(jie)服務,有效解決評(ping)審評(ping)估事項(xiang)多、耗(hao)時長、費用高等問(wen)題。重點整(zheng)治(zhi)各(ge)(ge)種涉企(qi)(qi)亂收費,完(wan)善(shan)涉企(qi)(qi)收費監督檢(jian)查制度,強(qiang)化(hua)舉報(bao)、查處和問(wen)責機制。組織(zhi)對涉企(qi)(qi)收費專項(xiang)監督檢(jian)查,切實減輕(qing)企(qi)(qi)業負擔。(財政部、國(guo)家發展改(gai)革委、工(gong)業和(he)信息化部牽頭,民(min)政部、質檢總局等相關部門按職責(ze)分工(gong)負(fu)責(ze))

  (六(liu))擴大(da)高校和科(ke)(ke)(ke)(ke)研(yan)院(yuan)(yuan)所(suo)(suo)自主(zhu)權。凡是束縛教(jiao)學(xue)科(ke)(ke)(ke)(ke)研(yan)人(ren)員積極(ji)性創(chuang)造性發揮(hui)的不合理(li)規(gui)定,都(dou)要(yao)取消或修改;凡是高校和科(ke)(ke)(ke)(ke)研(yan)院(yuan)(yuan)所(suo)(suo)能夠(gou)自主(zhu)管理(li)的事(shi)項,相關權限都(dou)要(yao)下放,特別(bie)是要(yao)擴大(da)高校和科(ke)(ke)(ke)(ke)研(yan)院(yuan)(yuan)所(suo)(suo)在經費使(shi)用(yong)、成果(guo)(guo)處置(zhi)、職(zhi)稱評審、選(xuan)人(ren)用(yong)人(ren)、薪酬(chou)分配、設(she)備采購、學(xue)科(ke)(ke)(ke)(ke)專業(ye)(ye)設(she)置(zhi)等(deng)方面(mian)的自主(zhu)權。落實完善支持教(jiao)學(xue)科(ke)(ke)(ke)(ke)研(yan)人(ren)員創(chuang)業(ye)(ye)創(chuang)新的股權期(qi)權激勵等(deng)相關政(zheng)策,促進科(ke)(ke)(ke)(ke)技成果(guo)(guo)轉化(hua)。為教(jiao)學(xue)科(ke)(ke)(ke)(ke)研(yan)人(ren)員從事(shi)兼職(zhi)創(chuang)業(ye)(ye)積極(ji)創(chuang)造寬(kuan)松條件(jian)。(教(jiao)育部(bu)、科(ke)(ke)(ke)(ke)技部(bu)牽頭,國務院(yuan)(yuan)審改辦、財政(zheng)部(bu)、人(ren)力(li)資源(yuan)社(she)會保障(zhang)部(bu)、海關總署、工商總局(ju)、稅務總局(ju)、國家知識產權局(ju)、中(zhong)國科(ke)(ke)(ke)(ke)學(xue)院(yuan)(yuan)、中(zhong)國社(she)科(ke)(ke)(ke)(ke)院(yuan)(yuan)、中(zhong)國工程院(yuan)(yuan)等(deng)相關部(bu)門、單位按職(zhi)責分工負(fu)責)

  (七)以政(zheng)(zheng)(zheng)務(wu)(wu)公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)(kai)(kai)推(tui)動(dong)(dong)簡政(zheng)(zheng)(zheng)放權(quan)(quan)(quan)。以更大力(li)(li)(li)度推(tui)進政(zheng)(zheng)(zheng)務(wu)(wu)公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)(kai)(kai),讓人民群(qun)眾(zhong)和企業(ye)了(le)解(jie)放權(quan)(quan)(quan)情況(kuang)、監督放權(quan)(quan)(quan)進程、評價(jia)放權(quan)(quan)(quan)效果,做到權(quan)(quan)(quan)力(li)(li)(li)公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)(kai)(kai)透明、群(qun)眾(zhong)明白辦事(shi)。全面(mian)(mian)公(gong)(gong)(gong)(gong)(gong)布地方各(ge)級政(zheng)(zheng)(zheng)府(fu)部(bu)(bu)(bu)門(men)權(quan)(quan)(quan)力(li)(li)(li)清單(dan)(dan)和責任(ren)清單(dan)(dan)。抓緊制(zhi)定(ding)國(guo)務(wu)(wu)院(yuan)試(shi)點部(bu)(bu)(bu)門(men)權(quan)(quan)(quan)力(li)(li)(li)清單(dan)(dan)和責任(ren)清單(dan)(dan);在部(bu)(bu)(bu)分(fen)地區試(shi)點市場準入(ru)負(fu)面(mian)(mian)清單(dan)(dan)制(zhi)度,進一步壓縮(suo)負(fu)面(mian)(mian)清單(dan)(dan);加快編制(zhi)行(xing)(xing)政(zheng)(zheng)(zheng)事(shi)業(ye)性收費、政(zheng)(zheng)(zheng)府(fu)定(ding)價(jia)或指導價(jia)經(jing)營(ying)服務(wu)(wu)性收費、政(zheng)(zheng)(zheng)府(fu)性基金、國(guo)家(jia)職(zhi)業(ye)資格、基本公(gong)(gong)(gong)(gong)(gong)共服務(wu)(wu)事(shi)項等(deng)(deng)各(ge)方面(mian)(mian)清單(dan)(dan),并及時主動(dong)(dong)向社會(hui)公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)(kai)(kai)。堅持(chi)“公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)(kai)(kai)為(wei)常態,不公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)(kai)(kai)為(wei)例外”,全面(mian)(mian)推(tui)進決策、執行(xing)(xing)、管理(li)、服務(wu)(wu)、結(jie)果公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)(kai)(kai)和重點領域信(xin)息公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)(kai)(kai)。落實行(xing)(xing)政(zheng)(zheng)(zheng)許可、行(xing)(xing)政(zheng)(zheng)(zheng)處罰等(deng)(deng)信(xin)息自作(zuo)出行(xing)(xing)政(zheng)(zheng)(zheng)決定(ding)之日起7個工(gong)作(zuo)日內上網(wang)公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)(kai)(kai)的要求。加大政(zheng)(zheng)(zheng)府(fu)信(xin)息數據開(kai)(kai)(kai)(kai)放力(li)(li)(li)度,除涉及國(guo)家(jia)安全、商(shang)(shang)業(ye)秘密、個人隱私(si)的外,都應向社會(hui)開(kai)(kai)(kai)(kai)放。及時公(gong)(gong)(gong)(gong)(gong)開(kai)(kai)(kai)(kai)突發敏感事(shi)件處置信(xin)息,回(hui)應社會(hui)關切(qie)。(國(guo)務(wu)(wu)院(yuan)辦公(gong)(gong)(gong)(gong)(gong)廳牽頭,國(guo)務(wu)(wu)院(yuan)審(shen)改辦、國(guo)家(jia)發展(zhan)改革委、教(jiao)育(yu)部(bu)(bu)(bu)、公(gong)(gong)(gong)(gong)(gong)安部(bu)(bu)(bu)、民政(zheng)(zheng)(zheng)部(bu)(bu)(bu)、財(cai)政(zheng)(zheng)(zheng)部(bu)(bu)(bu)、人力(li)(li)(li)資源社會(hui)保(bao)障部(bu)(bu)(bu)、住房城鄉建設部(bu)(bu)(bu)、商(shang)(shang)務(wu)(wu)部(bu)(bu)(bu)、國(guo)家(jia)衛生(sheng)計生(sheng)委、工(gong)商(shang)(shang)總局、國(guo)家(jia)統計局等(deng)(deng)相關部(bu)(bu)(bu)門(men)按(an)職(zhi)責分(fen)工(gong)負(fu)責)

  二、加強監(jian)管創新(xin),促進(jin)社會公平正義

  (八)實施公(gong)正(zheng)監(jian)管。推進(jin)(jin)政府(fu)監(jian)管體(ti)(ti)(ti)(ti)制改(gai)(gai)革(ge)(ge),加快構建(jian)(jian)事(shi)中(zhong)事(shi)后監(jian)管體(ti)(ti)(ti)(ti)系。全面推開“雙隨(sui)機(ji)、一(yi)(yi)公(gong)開”監(jian)管,抓緊建(jian)(jian)立(li)隨(sui)機(ji)抽(chou)查(cha)事(shi)項清單(dan)、檢查(cha)對(dui)象名錄(lu)庫(ku)和(he)執(zhi)法檢查(cha)人(ren)員名錄(lu)庫(ku),制定隨(sui)機(ji)抽(chou)查(cha)工(gong)作細則,今年(nian)(nian)縣級以上(shang)政府(fu)部門都要(yao)拿出(chu)“一(yi)(yi)單(dan)、兩庫(ku)、一(yi)(yi)細則”。隨(sui)機(ji)抽(chou)查(cha)事(shi)項,要(yao)達到本部門市場監(jian)管執(zhi)法事(shi)項的70%以上(shang)、其他行政執(zhi)法事(shi)項的50%以上(shang),力爭2017年(nian)(nian)實現全覆蓋(gai),充(chong)分(fen)體(ti)(ti)(ti)(ti)現監(jian)管的公(gong)平性(xing)、規范(fan)性(xing)和(he)簡(jian)約性(xing),并與信(xin)用(yong)監(jian)管、智(zhi)能監(jian)管聯動(dong),加強(qiang)社會(hui)信(xin)用(yong)體(ti)(ti)(ti)(ti)系建(jian)(jian)設,充(chong)分(fen)發揮全國(guo)信(xin)用(yong)信(xin)息共享平臺作用(yong),推進(jin)(jin)實施守(shou)信(xin)聯合激勵(li)和(he)失信(xin)聯合懲戒工(gong)作,加大“信(xin)用(yong)中(zhong)國(guo)”網站對(dui)失信(xin)行為的曝光(guang)力度。推進(jin)(jin)企業信(xin)用(yong)信(xin)息歸集公(gong)示工(gong)作。積極(ji)運用(yong)大數據、云計算、物(wu)聯網等信(xin)息技術,建(jian)(jian)立(li)健全市場主體(ti)(ti)(ti)(ti)誠信(xin)檔(dang)案(an)、行業黑名單(dan)制度和(he)市場退出(chu)機(ji)制。(國(guo)家(jia)發展改(gai)(gai)革(ge)(ge)委、人(ren)民銀行、工(gong)商總(zong)(zong)局(ju)牽頭,海關總(zong)(zong)署、稅務(wu)總(zong)(zong)局(ju)、質檢總(zong)(zong)局(ju)、食品藥品監(jian)管總(zong)(zong)局(ju)等相關部門按職(zhi)責分(fen)工(gong)負責)
