第三方檢測領域將迎來新發展!

  中(zhong)共中(zhong)央統(tong)一國務院于(yu)4月(yue)10日發布《中(zhong)共中(zhong)央國務院關(guan)于(yu)加快建(jian)設全國統(tong)一大市場的意見》。

  《意見》提出了全國統一的主要(yao)市(shi)場(chang),持續推進(jin)國內市(shi)場(chang)和通行規模展(zhan)開,打造包括穩定公平透明、可創新(xin)、暢通的商(shang)業(ye)(ye)交易目標的商(shang)業(ye)(ye)環境,降低市(shi)場(chang)成本,促進(jin)科(ke)技和產業(ye)(ye),鼓(gu)勵參與國際合(he)作競爭新(xin)優(you)勢。其中,針對第三(san)方檢測領域(yu)也(ye)做出相(xiang)關的發展(zhan)布局,以下是小(xiao)編整理(li)的《意見》中涉及第三(san)方檢測領域(yu)的內容:

  (十六)健全(quan)商品(pin)質(zhi)(zhi)量(liang)體(ti)系。建立健全(quan)質(zhi)(zhi)量(liang)分級(ji)制度,廣泛開展質(zhi)(zhi)量(liang)管理體(ti)系升級(ji)行動(dong),加(jia)強全(quan)供應鏈、全(quan)產(chan)(chan)業(ye)鏈、產(chan)(chan)品(pin)全(quan)生命周期管理。深化質(zhi)(zhi)量(liang)認(ren)(ren)(ren)證(zheng)制度改革,支持社會力量(liang)開展檢(jian)驗檢(jian)測業(ye)務(wu),探(tan)索推進計量(liang)區域中心(xin)、國(guo)家(jia)產(chan)(chan)品(pin)質(zhi)(zhi)量(liang)檢(jian)驗檢(jian)測中心(xin)建設,推動(dong)認(ren)(ren)(ren)證(zheng)結果跨行業(ye)跨區域互通互認(ren)(ren)(ren)。推動(dong)重點領域主要消費品(pin)質(zhi)(zhi)量(liang)標準與國(guo)際接軌,深化質(zhi)(zhi)量(liang)認(ren)(ren)(ren)證(zheng)國(guo)際合作互認(ren)(ren)(ren),實施產(chan)(chan)品(pin)傷害監測和預(yu)防(fang)干預(yu),完善質(zhi)(zhi)量(liang)統計監測體(ti)系。

  (十(shi)七)完(wan)善標(biao)準(zhun)和計量體系。緊貼(tie)戰(zhan)略性(xing)新興產(chan)業(ye)、高(gao)新技術(shu)產(chan)業(ye)、先進制造業(ye)等重點領(ling)域需求,突破(po)一(yi)批(pi)關鍵(jian)測(ce)量技術(shu),研制一(yi)批(pi)新型(xing)標(biao)準(zhun)物(wu)質,不斷(duan)完(wan)善國(guo)家(jia)計量體系。促進內外(wai)資企業(ye)公平參與我國(guo)標(biao)準(zhun)化工作,提高(gao)標(biao)準(zhun)制定(ding)修訂的透(tou)明(ming)度和開放度。開展標(biao)準(zhun)、計量等國(guo)際(ji)(ji)交流合作。加(jia)強(qiang)標(biao)準(zhun)必要(yao)專利(li)國(guo)際(ji)(ji)化建(jian)設(she),積極參與并推動國(guo)際(ji)(ji)知(zhi)識產(chan)權規(gui)則形成(cheng)。

  關于加快建設全國統一大市場的意見

  (2022年3月25日)

  建(jian)(jian)設全國統一大(da)市場(chang)是構建(jian)(jian)新發展(zhan)格局的基礎支(zhi)撐和內(nei)在(zai)要求。為從全局和戰略高度加快建(jian)(jian)設全國統一大(da)市場(chang),現提出如(ru)下意見。

  一、總體要求

  (一(yi))指(zhi)導(dao)思想(xiang)(xiang)。以習(xi)近平新時(shi)代中國特色社(she)會主(zhu)義思想(xiang)(xiang)為指(zhi)導(dao),全(quan)(quan)面(mian)貫(guan)徹(che)黨(dang)的(de)十九大(da)和十九屆歷(li)次(ci)全(quan)(quan)會精(jing)神,弘揚偉大(da)建(jian)(jian)(jian)黨(dang)精(jing)神,堅持(chi)(chi)穩中求進(jin)工(gong)作總基(ji)調,完整(zheng)、準(zhun)確、全(quan)(quan)面(mian)貫(guan)徹(che)新發展理(li)念,加快構建(jian)(jian)(jian)新發展格(ge)局,全(quan)(quan)面(mian)深(shen)化改(gai)革開(kai)放(fang),堅持(chi)(chi)創新驅(qu)動(dong)發展,推(tui)動(dong)高(gao)質量發展,堅持(chi)(chi)以供(gong)給側結構性改(gai)革為主(zhu)線,以滿足人民(min)日益(yi)增長的(de)美好生活需要為根本目(mu)的(de),統(tong)籌發展和安全(quan)(quan),充(chong)分(fen)發揮法治的(de)引領、規范(fan)(fan)、保(bao)障作用,加快建(jian)(jian)(jian)立全(quan)(quan)國統(tong)一(yi)的(de)市(shi)場(chang)制度規則,打破地方保(bao)護和市(shi)場(chang)分(fen)割,打通制約經濟循環的(de)關鍵堵點,促(cu)進(jin)商品要素資源在(zai)更大(da)范(fan)(fan)圍內暢通流動(dong),加快建(jian)(jian)(jian)設高(gao)效規范(fan)(fan)、公平競(jing)爭、充(chong)分(fen)開(kai)放(fang)的(de)全(quan)(quan)國統(tong)一(yi)大(da)市(shi)場(chang),全(quan)(quan)面(mian)推(tui)動(dong)我國市(shi)場(chang)由(you)大(da)到強轉變,為建(jian)(jian)(jian)設高(gao)標準(zhun)市(shi)場(chang)體系、構建(jian)(jian)(jian)高(gao)水平社(she)會主(zhu)義市(shi)場(chang)經濟體制提供(gong)堅強支撐。

  (二)工作原則

  ——立足內需,暢通(tong)循環。以高(gao)質量供給(gei)創造和引(yin)領需求,使生產、分配、流通(tong)、消費(fei)各環節更加暢通(tong),提高(gao)市場(chang)運行效率,進(jin)一(yi)步(bu)鞏固和擴展市場(chang)資源(yuan)優勢,使建設(she)超大規(gui)模的國內市場(chang)成為一(yi)個可(ke)持續的歷史過程(cheng)。

  ——立破(po)并舉(ju),完(wan)善制度(du)。從(cong)制度(du)建設著(zhu)眼,明(ming)確(que)階段性目(mu)標(biao)要(yao)求,壓茬推進統一市場建設,同(tong)時堅(jian)持問題(ti)導向,著(zhu)力解決突出矛(mao)盾和問題(ti),加快清理廢除(chu)妨礙(ai)統一市場和公(gong)平競爭的各(ge)種規定(ding)和做法,破(po)除(chu)各(ge)種封閉小(xiao)市場、自我小(xiao)循環(huan)。

  ——有效市(shi)(shi)場(chang),有為政(zheng)府。堅持市(shi)(shi)場(chang)化(hua)、法治化(hua)原(yuan)則,充(chong)分發(fa)揮市(shi)(shi)場(chang)在資源配置中的決(jue)定性作(zuo)用,更好(hao)(hao)(hao)發(fa)揮政(zheng)府作(zuo)用,強化(hua)競爭(zheng)政(zheng)策基礎地(di)(di)(di)位,加快轉變政(zheng)府職能,用足用好(hao)(hao)(hao)超大規模(mo)市(shi)(shi)場(chang)優勢,讓需(xu)求(qiu)更好(hao)(hao)(hao)地(di)(di)(di)引領優化(hua)供(gong)給,讓供(gong)給更好(hao)(hao)(hao)地(di)(di)(di)服務擴大需(xu)求(qiu),以統一大市(shi)(shi)場(chang)集聚資源、推動增長、激(ji)勵創新、優化(hua)分工、促(cu)進競爭(zheng)。

  ——系統(tong)協(xie)同(tong)(tong),穩妥推進。不(bu)斷提高政策的(de)(de)(de)統(tong)一(yi)性(xing)、規(gui)則的(de)(de)(de)一(yi)致性(xing)、執行(xing)的(de)(de)(de)協(xie)同(tong)(tong)性(xing),科學(xue)把握市場(chang)規(gui)模、結構、組(zu)織、空間、環境和(he)(he)機制建(jian)設的(de)(de)(de)步(bu)驟與進度,堅持放(fang)管結合(he)、放(fang)管并重,提升政府(fu)監管效能(neng),增(zeng)強在開放(fang)環境中(zhong)動態維護市場(chang)穩定、經濟(ji)安全的(de)(de)(de)能(neng)力(li),有(you)序擴大(da)統(tong)一(yi)大(da)市場(chang)的(de)(de)(de)影響(xiang)力(li)和(he)(he)輻射(she)力(li)。

  (三)主要目標

  ——持(chi)續(xu)推動國(guo)(guo)內(nei)(nei)市(shi)(shi)場(chang)(chang)高效暢通(tong)(tong)和(he)規模拓(tuo)展。發揮市(shi)(shi)場(chang)(chang)促進競爭、深化分工等優(you)勢,進一(yi)步打通(tong)(tong)市(shi)(shi)場(chang)(chang)效率提(ti)升、勞動生產率提(ti)高、居民收入增加、市(shi)(shi)場(chang)(chang)主體壯大(da)(da)、供給(gei)質量(liang)(liang)提(ti)升、需求優(you)化升級之間(jian)的通(tong)(tong)道,努(nu)力形成供需互促、產銷并進、暢通(tong)(tong)高效的國(guo)(guo)內(nei)(nei)大(da)(da)循環,擴大(da)(da)市(shi)(shi)場(chang)(chang)規模容(rong)量(liang)(liang),不斷培育(yu)發展強(qiang)大(da)(da)國(guo)(guo)內(nei)(nei)市(shi)(shi)場(chang)(chang),保持(chi)和(he)增強(qiang)對全球(qiu)企(qi)業、資(zi)源的強(qiang)大(da)(da)吸引力。

  ——加快(kuai)營造(zao)(zao)穩定公(gong)平(ping)(ping)透(tou)明可預期的(de)營商環境。以(yi)市(shi)(shi)場(chang)主體需求為(wei)導向,力行簡(jian)政之道(dao),堅持依法行政,公(gong)平(ping)(ping)公(gong)正監管,持續優化服務,加快(kuai)打造(zao)(zao)市(shi)(shi)場(chang)化法治化國際化營商環境。充分發揮各地區比較優勢,因地制宜為(wei)各類市(shi)(shi)場(chang)主體投(tou)資興(xing)業營造(zao)(zao)良好生態。

  ——進(jin)(jin)一步降低(di)市(shi)(shi)場交易(yi)成(cheng)本。發揮市(shi)(shi)場的(de)規模效應(ying)和(he)集(ji)聚效應(ying),加強和(he)改進(jin)(jin)反(fan)壟斷反(fan)不(bu)正當競爭執法司(si)法,破除妨礙(ai)各(ge)種生(sheng)產要(yao)素(su)市(shi)(shi)場化配置和(he)商品服務流(liu)(liu)通的(de)體制(zhi)機制(zhi)障礙(ai),降低(di)制(zhi)度(du)性交易(yi)成(cheng)本。促(cu)進(jin)(jin)現(xian)代流(liu)(liu)通體系建設,降低(di)全社會(hui)流(liu)(liu)通成(cheng)本。

  ——促(cu)(cu)進科(ke)技創(chuang)新(xin)(xin)(xin)(xin)和(he)產業升級。發(fa)揮超大規模市(shi)場具有(you)(you)豐富(fu)應用(yong)場景和(he)放大創(chuang)新(xin)(xin)(xin)(xin)收(shou)益的優勢,通過(guo)市(shi)場需求引(yin)導創(chuang)新(xin)(xin)(xin)(xin)資源有(you)(you)效配(pei)置,促(cu)(cu)進創(chuang)新(xin)(xin)(xin)(xin)要素有(you)(you)序(xu)流動和(he)合理(li)配(pei)置,完(wan)善促(cu)(cu)進自主創(chuang)新(xin)(xin)(xin)(xin)成果市(shi)場化應用(yong)的體(ti)制機制,支撐科(ke)技創(chuang)新(xin)(xin)(xin)(xin)和(he)新(xin)(xin)(xin)(xin)興產業發(fa)展。

  ——培(pei)育(yu)參(can)與國(guo)際競爭(zheng)合作(zuo)新優(you)勢。以國(guo)內大(da)循環和統一(yi)大(da)市(shi)場(chang)(chang)為支(zhi)撐,有(you)效利用全球要素(su)和市(shi)場(chang)(chang)資源,使國(guo)內市(shi)場(chang)(chang)與國(guo)際市(shi)場(chang)(chang)更(geng)好聯通。推動制度(du)型開放,增強在(zai)全球產(chan)業鏈供應鏈創新鏈中(zhong)的(de)(de)影響力,提(ti)升在(zai)國(guo)際經濟(ji)治理中(zhong)的(de)(de)話語(yu)權。

  二、強化市場基礎制度規則統一

  (四)完(wan)(wan)善統(tong)(tong)一(yi)(yi)的(de)(de)產權保(bao)護制(zhi)(zhi)度(du)。完(wan)(wan)善依法(fa)平等保(bao)護各(ge)種所(suo)有制(zhi)(zhi)經濟產權的(de)(de)制(zhi)(zhi)度(du)體系(xi)。健全(quan)(quan)統(tong)(tong)一(yi)(yi)規(gui)范(fan)的(de)(de)涉產權糾紛案件執(zhi)法(fa)司(si)法(fa)體系(xi),強(qiang)化執(zhi)法(fa)司(si)法(fa)部門協(xie)同,進(jin)(jin)一(yi)(yi)步規(gui)范(fan)執(zhi)法(fa)領域涉產權強(qiang)制(zhi)(zhi)措施規(gui)則和程序,進(jin)(jin)一(yi)(yi)步明(ming)確(que)和統(tong)(tong)一(yi)(yi)行政(zheng)執(zhi)法(fa)、司(si)法(fa)裁判標準(zhun),健全(quan)(quan)行政(zheng)執(zhi)法(fa)與刑事司(si)法(fa)雙向銜接(jie)機制(zhi)(zhi),依法(fa)保(bao)護企業產權及企業家人身財產安(an)全(quan)(quan)。推(tui)動知(zhi)識產權訴訟制(zhi)(zhi)度(du)創新,完(wan)(wan)善知(zhi)識產權法(fa)院跨區(qu)域管轄制(zhi)(zhi)度(du),暢通知(zhi)識產權訴訟與仲裁、調解的(de)(de)對(dui)接(jie)機制(zhi)(zhi)。

  (五)實(shi)行統(tong)一(yi)的市(shi)場準(zhun)(zhun)入(ru)(ru)制度。嚴(yan)格落實(shi)“全(quan)(quan)國(guo)(guo)(guo)一(yi)張清單”管理模(mo)式(shi),嚴(yan)禁各地區各部(bu)門自行發布具有市(shi)場準(zhun)(zhun)入(ru)(ru)性(xing)質的負面清單,維護市(shi)場準(zhun)(zhun)入(ru)(ru)負面清單制度的統(tong)一(yi)性(xing)、嚴(yan)肅性(xing)、權威性(xing)。研究完(wan)善市(shi)場準(zhun)(zhun)入(ru)(ru)效(xiao)(xiao)能評(ping)估指(zhi)標,穩步(bu)開展市(shi)場準(zhun)(zhun)入(ru)(ru)效(xiao)(xiao)能評(ping)估。依法開展市(shi)場主體(ti)登(deng)(deng)記注冊工作,建立全(quan)(quan)國(guo)(guo)(guo)統(tong)一(yi)的登(deng)(deng)記注冊數據標準(zhun)(zhun)和企業名稱(cheng)自主申(shen)報行業字詞庫,逐(zhu)步(bu)實(shi)現經營范(fan)圍登(deng)(deng)記的統(tong)一(yi)表述。制定全(quan)(quan)國(guo)(guo)(guo)通用性(xing)資格清單,統(tong)一(yi)規范(fan)評(ping)價程序(xu)及管理辦(ban)法,提升全(quan)(quan)國(guo)(guo)(guo)互(hu)(hu)(hu)通互(hu)(hu)(hu)認互(hu)(hu)(hu)用效(xiao)(xiao)力。

  (六)維護(hu)統一(yi)的公平(ping)競爭制度。堅持對各類市場主體一(yi)視同(tong)仁、平(ping)等對待。健(jian)(jian)全公平(ping)競爭制度框架(jia)和政(zheng)策實(shi)(shi)施機制,建(jian)立公平(ping)競爭政(zheng)策與產業(ye)政(zheng)策協調保障(zhang)機制,優化完善產業(ye)政(zheng)策實(shi)(shi)施方式。健(jian)(jian)全反壟(long)斷法律規則體系,加快推動修改反壟(long)斷法、反不正當競爭法,完善公平(ping)競爭審(shen)查(cha)制度,研究重點領域和行業(ye)性審(shen)查(cha)規則,健(jian)(jian)全審(shen)查(cha)機制,統一(yi)審(shen)查(cha)標(biao)準,規范審(shen)查(cha)程序,提高(gao)審(shen)查(cha)效能。

  (七)健全統一的社(she)(she)會(hui)信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)制(zhi)(zhi)度(du)。編制(zhi)(zhi)出臺全國公(gong)共信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)(xin)息(xi)(xi)基(ji)(ji)礎目錄,完善信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)(xin)息(xi)(xi)標準,建(jian)立公(gong)共信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)(xin)息(xi)(xi)同金融(rong)信(xin)(xin)(xin)(xin)(xin)息(xi)(xi)共享整合機制(zhi)(zhi),形成覆(fu)蓋全部信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)主體(ti)(ti)、所有信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)(xin)息(xi)(xi)類別、全國所有區(qu)域的信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)(xin)息(xi)(xi)網(wang)絡。建(jian)立健全以信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)為基(ji)(ji)礎的新型監管(guan)機制(zhi)(zhi),全面(mian)推廣信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)承諾制(zhi)(zhi)度(du),建(jian)立企(qi)業信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)狀況(kuang)綜合評(ping)價體(ti)(ti)系,以信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)風險為導向優化配(pei)置監管(guan)資(zi)源,依(yi)(yi)法(fa)(fa)依(yi)(yi)規編制(zhi)(zhi)出臺全國失(shi)信(xin)(xin)(xin)(xin)(xin)懲戒(jie)措施基(ji)(ji)礎清單。健全守信(xin)(xin)(xin)(xin)(xin)激勵和失(shi)信(xin)(xin)(xin)(xin)(xin)懲戒(jie)機制(zhi)(zhi),將失(shi)信(xin)(xin)(xin)(xin)(xin)懲戒(jie)和懲治腐敗(bai)相結合。完善信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)修復(fu)機制(zhi)(zhi)。加快推進社(she)(she)會(hui)信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)立法(fa)(fa)。

  三、推進市場設施高標準聯通

  (八(ba))建(jian)(jian)設(she)現代流(liu)通(tong)網(wang)絡(luo)(luo)。優化(hua)(hua)(hua)商(shang)貿(mao)流(liu)通(tong)基(ji)礎設(she)施(shi)布局,加快數字化(hua)(hua)(hua)建(jian)(jian)設(she),推動(dong)線(xian)上(shang)線(xian)下融合(he)發展(zhan),形成更(geng)多(duo)商(shang)貿(mao)流(liu)通(tong)新平(ping)臺(tai)新業(ye)態新模式(shi)。推動(dong)國家物(wu)流(liu)樞(shu)(shu)紐(niu)網(wang)絡(luo)(luo)建(jian)(jian)設(she),大(da)力(li)發展(zhan)多(duo)式(shi)聯(lian)(lian)運(yun)(yun),推廣標準化(hua)(hua)(hua)托盤(pan)帶板運(yun)(yun)輸模式(shi)。大(da)力(li)發展(zhan)第(di)三方物(wu)流(liu),支持數字化(hua)(hua)(hua)第(di)三方物(wu)流(liu)交付平(ping)臺(tai)建(jian)(jian)設(she),推動(dong)第(di)三方物(wu)流(liu)產(chan)業(ye)科(ke)技和(he)(he)商(shang)業(ye)模式(shi)創新,培育一(yi)批有(you)全球(qiu)影(ying)響(xiang)力(li)的(de)數字化(hua)(hua)(hua)平(ping)臺(tai)企業(ye)和(he)(he)供應(ying)鏈企業(ye),促進全社會物(wu)流(liu)降本增效。加強應(ying)急物(wu)流(liu)體系建(jian)(jian)設(she),提升災害(hai)高風險(xian)區(qu)域交通(tong)運(yun)(yun)輸設(she)施(shi)、物(wu)流(liu)站點等(deng)設(she)防(fang)水平(ping)和(he)(he)承災能(neng)力(li),積極防(fang)范糧食、能(neng)源(yuan)等(deng)重要產(chan)品供應(ying)短(duan)缺風險(xian)。完善國家綜合(he)立體交通(tong)網(wang),推進多(duo)層次一(yi)體化(hua)(hua)(hua)綜合(he)交通(tong)樞(shu)(shu)紐(niu)建(jian)(jian)設(she),推動(dong)交通(tong)運(yun)(yun)輸設(she)施(shi)跨區(qu)域一(yi)體化(hua)(hua)(hua)發展(zhan)。建(jian)(jian)立健全城鄉融合(he)、區(qu)域聯(lian)(lian)通(tong)、安全高效的(de)電信、能(neng)源(yuan)等(deng)基(ji)礎設(she)施(shi)網(wang)絡(luo)(luo)。

  (九)完(wan)善市(shi)(shi)場信息(xi)(xi)交(jiao)(jiao)互(hu)渠(qu)道。統(tong)(tong)一產權交(jiao)(jiao)易信息(xi)(xi)發布機制(zhi),實現全國產權交(jiao)(jiao)易市(shi)(shi)場聯(lian)通。優(you)化(hua)行業公(gong)告公(gong)示等(deng)重(zhong)要(yao)信息(xi)(xi)發布渠(qu)道,推動各領(ling)域市(shi)(shi)場公(gong)共(gong)(gong)信息(xi)(xi)互(hu)通共(gong)(gong)享。優(you)化(hua)市(shi)(shi)場主體信息(xi)(xi)公(gong)示,便(bian)利市(shi)(shi)場主體信息(xi)(xi)互(hu)聯(lian)互(hu)通。推進(jin)同類(lei)型(xing)及同目的信息(xi)(xi)認證平臺(tai)統(tong)(tong)一接(jie)口(kou)建設,完(wan)善接(jie)口(kou)標準,促進(jin)市(shi)(shi)場信息(xi)(xi)流動和高效使用。依法公(gong)開市(shi)(shi)場主體、投資項目、產量、產能等(deng)信息(xi)(xi),引導供需動態平衡(heng)。

  七、進一步規范不當市場競爭和市場干預行為

  (二十二)著(zhu)力強化反(fan)壟(long)(long)(long)斷(duan)(duan)。完善壟(long)(long)(long)斷(duan)(duan)行(xing)為認定法律規則,健(jian)全(quan)經(jing)營者集(ji)中(zhong)分(fen)類分(fen)級(ji)反(fan)壟(long)(long)(long)斷(duan)(duan)審查(cha)制度。破除平臺企(qi)業(ye)數據壟(long)(long)(long)斷(duan)(duan)等(deng)問(wen)題,防止利用數據、算法、技術手段等(deng)方式排除、限制競爭(zheng)。加(jia)強對(dui)金(jin)融、傳媒(mei)、科(ke)技、民生等(deng)領域和涉及初(chu)創企(qi)業(ye)、新(xin)業(ye)態、勞動密(mi)集(ji)型(xing)行(xing)業(ye)的(de)(de)經(jing)營者集(ji)中(zhong)審查(cha),提高(gao)審查(cha)質量和效率,強化壟(long)(long)(long)斷(duan)(duan)風(feng)險識(shi)別、預警、防范。穩步推(tui)進自然壟(long)(long)(long)斷(duan)(duan)行(xing)業(ye)改革,加(jia)強對(dui)電網(wang)、油氣管(guan)網(wang)等(deng)網(wang)絡型(xing)自然壟(long)(long)(long)斷(duan)(duan)環節(jie)的(de)(de)監管(guan)。加(jia)強對(dui)創新(xin)型(xing)中(zhong)小企(qi)業(ye)原始(shi)創新(xin)和知識(shi)產權的(de)(de)保護。

  (二十三)依法(fa)查(cha)處不(bu)(bu)正(zheng)當(dang)(dang)競爭(zheng)(zheng)行為。對市場主(zhu)體、消費者反(fan)映強(qiang)(qiang)烈的重(zhong)點行業和領(ling)域,加(jia)強(qiang)(qiang)全(quan)鏈條競爭(zheng)(zheng)監(jian)管(guan)執(zhi)法(fa),以公正(zheng)監(jian)管(guan)保(bao)障公平(ping)競爭(zheng)(zheng)。加(jia)強(qiang)(qiang)對平(ping)臺(tai)經濟、共(gong)(gong)享(xiang)經濟等新業態(tai)領(ling)域不(bu)(bu)正(zheng)當(dang)(dang)競爭(zheng)(zheng)行為的規制,整治網(wang)絡黑灰產業鏈條,治理新型網(wang)絡不(bu)(bu)正(zheng)當(dang)(dang)競爭(zheng)(zheng)行為。健(jian)全(quan)跨(kua)部門(men)跨(kua)行政(zheng)區(qu)域的反(fan)不(bu)(bu)正(zheng)當(dang)(dang)競爭(zheng)(zheng)執(zhi)法(fa)信息共(gong)(gong)享(xiang)、協作(zuo)聯動機制,提高(gao)執(zhi)法(fa)的統一性、權威性、協調性。構建跨(kua)行政(zheng)區(qu)域的反(fan)不(bu)(bu)正(zheng)當(dang)(dang)競爭(zheng)(zheng)案(an)件移送(song)、執(zhi)法(fa)協助、聯合執(zhi)法(fa)機制,針對新型、疑難(nan)、典型案(an)件暢通會(hui)商(shang)渠道、互(hu)通裁(cai)量標準(zhun)。

  (二(er)十四)破(po)除地(di)(di)方保(bao)(bao)(bao)護(hu)和(he)(he)區(qu)(qu)域壁壘。指導各(ge)地(di)(di)區(qu)(qu)綜合比較優(you)(you)勢、資(zi)(zi)源環(huan)境承(cheng)載能(neng)力、產(chan)業(ye)基礎、防災避險能(neng)力等因素,找準自(zi)身功(gong)能(neng)定位,力戒貪大(da)求洋、低層次重復(fu)建(jian)設(she)和(he)(he)過(guo)度(du)同質競爭,不搞“小(xiao)而全”的自(zi)我(wo)小(xiao)循環(huan),更不能(neng)以(yi)“內循環(huan)”的名義(yi)搞地(di)(di)區(qu)(qu)封鎖。建(jian)立涉企優(you)(you)惠政(zheng)策(ce)(ce)目錄清單并及(ji)時向社會公開(kai),及(ji)時清理(li)廢除各(ge)地(di)(di)區(qu)(qu)含有地(di)(di)方保(bao)(bao)(bao)護(hu)、市場分割、指定交易(yi)等妨礙統一(yi)市場和(he)(he)公平競爭的政(zheng)策(ce)(ce),全面(mian)清理(li)歧視外(wai)資(zi)(zi)企業(ye)和(he)(he)外(wai)地(di)(di)企業(ye)、實行地(di)(di)方保(bao)(bao)(bao)護(hu)的各(ge)類優(you)(you)惠政(zheng)策(ce)(ce),對新出臺政(zheng)策(ce)(ce)嚴格開(kai)展公平競爭審查。加強地(di)(di)區(qu)(qu)間產(chan)業(ye)轉移項(xiang)目協調合作,建(jian)立重大(da)問題協調解決機制(zhi),推動產(chan)業(ye)合理(li)布(bu)局、分工進(jin)一(yi)步優(you)(you)化。鼓勵各(ge)地(di)(di)區(qu)(qu)持續優(you)(you)化營商(shang)(shang)(shang)環(huan)境,依(yi)法開(kai)展招商(shang)(shang)(shang)引(yin)資(zi)(zi)活動,防止招商(shang)(shang)(shang)引(yin)資(zi)(zi)惡性競爭行為,以(yi)優(you)(you)質的制(zhi)度(du)供給和(he)(he)制(zhi)度(du)創(chuang)新吸引(yin)更多(duo)優(you)(you)質企業(ye)投(tou)資(zi)(zi)。

  (二十五)清理廢除妨礙依法(fa)(fa)平等準(zhun)(zhun)入(ru)和退出的規定(ding)(ding)做法(fa)(fa)。除法(fa)(fa)律法(fa)(fa)規明確規定(ding)(ding)外,不(bu)(bu)(bu)得(de)(de)要(yao)(yao)求(qiu)(qiu)企(qi)(qi)業(ye)必須在某地(di)(di)登記注冊,不(bu)(bu)(bu)得(de)(de)為企(qi)(qi)業(ye)跨區域經(jing)營(ying)(ying)或遷移設(she)(she)置(zhi)障礙。不(bu)(bu)(bu)得(de)(de)設(she)(she)置(zhi)不(bu)(bu)(bu)合理和歧視性的準(zhun)(zhun)入(ru)、退出條(tiao)(tiao)件以限(xian)制商品(pin)服(fu)(fu)務(wu)(wu)、要(yao)(yao)素資(zi)源自由流動。不(bu)(bu)(bu)得(de)(de)以備(bei)案、注冊、年(nian)檢(jian)(jian)、認(ren)定(ding)(ding)、認(ren)證(zheng)(zheng)、指定(ding)(ding)、要(yao)(yao)求(qiu)(qiu)設(she)(she)立分(fen)公司(si)等形式設(she)(she)定(ding)(ding)或者(zhe)變相設(she)(she)定(ding)(ding)準(zhun)(zhun)入(ru)障礙。不(bu)(bu)(bu)得(de)(de)在資(zi)質認(ren)定(ding)(ding)、業(ye)務(wu)(wu)許可等方(fang)面,對(dui)外地(di)(di)企(qi)(qi)業(ye)設(she)(she)定(ding)(ding)明顯高于(yu)本地(di)(di)經(jing)營(ying)(ying)者(zhe)的資(zi)質要(yao)(yao)求(qiu)(qiu)、技術要(yao)(yao)求(qiu)(qiu)、檢(jian)(jian)驗(yan)(yan)標準(zhun)(zhun)或評審標準(zhun)(zhun)。清理規范行政(zheng)審批、許可、備(bei)案等政(zheng)務(wu)(wu)服(fu)(fu)務(wu)(wu)事(shi)項的前置(zhi)條(tiao)(tiao)件和審批標準(zhun)(zhun),不(bu)(bu)(bu)得(de)(de)將政(zheng)務(wu)(wu)服(fu)(fu)務(wu)(wu)事(shi)項轉為中介(jie)服(fu)(fu)務(wu)(wu)事(shi)項,沒(mei)有法(fa)(fa)律法(fa)(fa)規依據不(bu)(bu)(bu)得(de)(de)在政(zheng)務(wu)(wu)服(fu)(fu)務(wu)(wu)前要(yao)(yao)求(qiu)(qiu)企(qi)(qi)業(ye)自行檢(jian)(jian)測(ce)、檢(jian)(jian)驗(yan)(yan)、認(ren)證(zheng)(zheng)、鑒定(ding)(ding)、公證(zheng)(zheng)以及提(ti)供證(zheng)(zheng)明等,不(bu)(bu)(bu)得(de)(de)搞變相審批、有償服(fu)(fu)務(wu)(wu)。未(wei)經(jing)公平競爭不(bu)(bu)(bu)得(de)(de)授予經(jing)營(ying)(ying)者(zhe)特許經(jing)營(ying)(ying)權,不(bu)(bu)(bu)得(de)(de)限(xian)定(ding)(ding)經(jing)營(ying)(ying)、購買、使(shi)用特定(ding)(ding)經(jing)營(ying)(ying)者(zhe)提(ti)供的商品(pin)和服(fu)(fu)務(wu)(wu)。

  (二十六)持續(xu)清理招標(biao)采購領域違(wei)反統一市(shi)場建設的規(gui)定(ding)和(he)做法(fa)(fa)(fa)。制(zhi)(zhi)定(ding)招標(biao)投(tou)(tou)標(biao)和(he)政(zheng)府采購制(zhi)(zhi)度(du)規(gui)則要嚴格按照國家(jia)有關規(gui)定(ding)進行(xing)公平競爭審查、合法(fa)(fa)(fa)性審核。招標(biao)投(tou)(tou)標(biao)和(he)政(zheng)府采購中嚴禁違(wei)法(fa)(fa)(fa)限(xian)定(ding)或者(zhe)指定(ding)特(te)定(ding)的專利、商(shang)(shang)標(biao)、品牌(pai)、零部件、原產(chan)地(di)(di)、供應(ying)(ying)商(shang)(shang),不得違(wei)法(fa)(fa)(fa)設定(ding)與招標(biao)采購項目具體特(te)點和(he)實際需要不相適應(ying)(ying)的資格、技(ji)術(shu)、商(shang)(shang)務(wu)條件等。不得違(wei)法(fa)(fa)(fa)限(xian)定(ding)投(tou)(tou)標(biao)人所在地(di)(di)、所有制(zhi)(zhi)形式、組織形式,或者(zhe)設定(ding)其他不合理的條件以排斥、限(xian)制(zhi)(zhi)經營(ying)者(zhe)參與投(tou)(tou)標(biao)采購活動(dong)。深入推進招標(biao)投(tou)(tou)標(biao)全流(liu)程電(dian)子化,加快(kuai)完善電(dian)子招標(biao)投(tou)(tou)標(biao)制(zhi)(zhi)度(du)規(gui)則、技(ji)術(shu)標(biao)準,推動(dong)優質評標(biao)專家(jia)等資源跨(kua)地(di)(di)區(qu)跨(kua)行(xing)業(ye)共享。

  八、組織實施保障

  (二十(shi)七(qi))加強黨(dang)的領導。各(ge)地區各(ge)部門要(yao)充分認識建設全(quan)國(guo)(guo)統(tong)一(yi)大市場(chang)對于(yu)構(gou)建新發展格(ge)局的重要(yao)意義,切實把思想和行動統(tong)一(yi)到黨(dang)中央(yang)決策部署上來(lai),做到全(quan)國(guo)(guo)一(yi)盤棋(qi),統(tong)一(yi)大市場(chang),暢通大循環,確保各(ge)項重點任務落到實處。

  (二十八(ba))完(wan)善激(ji)勵約束機制。探(tan)索研究全國(guo)統一(yi)大市(shi)(shi)場建設(she)標(biao)準指南(nan),對積極(ji)推動落實全國(guo)統一(yi)大市(shi)(shi)場建設(she)、取得突出成效的(de)地區(qu)可按國(guo)家有(you)關規定(ding)予以獎勵。動態發布不當(dang)干(gan)(gan)預全國(guo)統一(yi)大市(shi)(shi)場建設(she)問(wen)題(ti)清單(dan),建立典型案例通(tong)報(bao)約談和問(wen)題(ti)整(zheng)改制度(du),著力(li)解決妨礙全國(guo)統一(yi)大市(shi)(shi)場建設(she)的(de)不當(dang)市(shi)(shi)場干(gan)(gan)預和不當(dang)競爭行為問(wen)題(ti)。

  (二十(shi)九)優先推(tui)進區(qu)域(yu)(yu)(yu)協(xie)作。結合(he)區(qu)域(yu)(yu)(yu)重大(da)戰(zhan)略、區(qu)域(yu)(yu)(yu)協(xie)調發展戰(zhan)略實施,鼓勵京津冀、長三角(jiao)、粵(yue)港澳大(da)灣區(qu)以及成渝地區(qu)雙城(cheng)(cheng)經濟圈(quan)、長江中游城(cheng)(cheng)市(shi)群等(deng)區(qu)域(yu)(yu)(yu),在維護全(quan)國統一大(da)市(shi)場前提下(xia),優先開展區(qu)域(yu)(yu)(yu)市(shi)場一體化建設工作,建立健全(quan)區(qu)域(yu)(yu)(yu)合(he)作機制,積極總結并復制推(tui)廣典型經驗和做法。

  (三十(shi))形成工作合力。各地(di)區各部門(men)要根據職責分(fen)工,不折不扣落實本(ben)(ben)意見要求,對本(ben)(ben)地(di)區本(ben)(ben)部門(men)是否存在妨(fang)礙全(quan)國(guo)(guo)(guo)(guo)統(tong)(tong)(tong)一大市場(chang)建設(she)的(de)(de)規定和(he)實際情況開(kai)展(zhan)自查清(qing)理。國(guo)(guo)(guo)(guo)家(jia)發(fa)展(zhan)改革委、市場(chang)監(jian)管總局會同有關部門(men)建立(li)健全(quan)促進全(quan)國(guo)(guo)(guo)(guo)統(tong)(tong)(tong)一大市場(chang)建設(she)的(de)(de)部門(men)協調機制,加大統(tong)(tong)(tong)籌(chou)協調力度,強(qiang)化跟蹤評估,及(ji)時督促檢查,推動各方抓好貫徹落實。加強(qiang)宣傳引導和(he)輿論監(jian)督,為(wei)全(quan)國(guo)(guo)(guo)(guo)統(tong)(tong)(tong)一大市場(chang)建設(she)營造良好社會氛圍。重(zhong)大事項及(ji)時向黨中(zhong)央、國(guo)(guo)(guo)(guo)務院請示報告。
