中共中央、國務院:行業協會商會擬后年與行政機關脫鉤

  新華社北(bei)京7月8日電 中(zhong)共中(zhong)央辦公(gong)廳、國務院辦公(gong)廳近日印(yin)發了(le)《行業協(xie)會商會與行政(zheng)機關脫(tuo)鉤總體方(fang)案》,并發出通知,要求(qiu)各地(di)區各部門結(jie)合實際認真貫徹執行。

  《行業協會商會與行政機(ji)關脫(tuo)鉤總體方案》全文如(ru)下。

  行業(ye)(ye)(ye)(ye)協會(hui)(hui)商(shang)會(hui)(hui)是我(wo)國經濟(ji)建設和(he)社會(hui)(hui)發展(zhan)的(de)重(zhong)要力量。改(gai)革(ge)開放以來,隨著社會(hui)(hui)主義市場經濟(ji)體制(zhi)的(de)建立和(he)完善,行業(ye)(ye)(ye)(ye)協會(hui)(hui)商(shang)會(hui)(hui)發展(zhan)迅(xun)速,在(zai)為(wei)政府提供咨詢(xun)、服務企業(ye)(ye)(ye)(ye)發展(zhan)、優化(hua)資源配置、加強行業(ye)(ye)(ye)(ye)自(zi)律、創(chuang)新社會(hui)(hui)治理、履行社會(hui)(hui)責任等方(fang)面(mian)(mian)發揮了(le)積極(ji)作用(yong)。目前,一些(xie)行業(ye)(ye)(ye)(ye)協會(hui)(hui)商(shang)會(hui)(hui)還存在(zai)政會(hui)(hui)不(bu)分、管辦一體、治理結(jie)構不(bu)健全、監督管理不(bu)到位、創(chuang)新發展(zhan)不(bu)足、作用(yong)發揮不(bu)夠等問題。按照《中共中央關(guan)于全面(mian)(mian)深化(hua)改(gai)革(ge)若干(gan)重(zhong)大問題的(de)決(jue)定(ding)》、《國務院機構改(gai)革(ge)和(he)職能(neng)轉(zhuan)變方(fang)案(an)》有關(guan)精神和(he)工(gong)作部署,為(wei)加快轉(zhuan)變政府職能(neng),實現行業(ye)(ye)(ye)(ye)協會(hui)(hui)商(shang)會(hui)(hui)與行政機關(guan)脫鉤,促進行業(ye)(ye)(ye)(ye)協會(hui)(hui)商(shang)會(hui)(hui)規范發展(zhan),制(zhi)定(ding)本方(fang)案(an)。

  一、總體要求(qiu)和基本原(yuan)則(ze)

  (一)總體要求(qiu)

  貫徹落實黨(dang)的(de)十八(ba)大(da)和(he)十八(ba)屆二中(zhong)(zhong)、三中(zhong)(zhong)、四中(zhong)(zhong)全會(hui)(hui)(hui)精(jing)神,加(jia)快(kuai)形成(cheng)政(zheng)社(she)分開、權責明確、依(yi)法自(zi)(zi)治的(de)現代社(she)會(hui)(hui)(hui)組織(zhi)體制(zhi),理清(qing)(qing)政(zheng)府、市(shi)場、社(she)會(hui)(hui)(hui)關(guan)系,積極穩(wen)妥推進行(xing)業(ye)協會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)與行(xing)政(zheng)機關(guan)脫鉤(gou),厘清(qing)(qing)行(xing)政(zheng)機關(guan)與行(xing)業(ye)協會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)的(de)職能(neng)邊界,加(jia)強(qiang)綜(zong)合監管(guan)和(he)黨(dang)建工(gong)作,促進行(xing)業(ye)協會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)成(cheng)為(wei)依(yi)法設立、自(zi)(zi)主辦會(hui)(hui)(hui)、服務(wu)為(wei)本、治理規范、行(xing)為(wei)自(zi)(zi)律的(de)社(she)會(hui)(hui)(hui)組織(zhi)。創新行(xing)業(ye)協會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)管(guan)理體制(zhi)和(he)運(yun)行(xing)機制(zhi),激發(fa)內在(zai)活力和(he)發(fa)展動(dong)力,提升行(xing)業(ye)服務(wu)功能(neng),充分發(fa)揮行(xing)業(ye)協會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)在(zai)經濟發(fa)展新常態中(zhong)(zhong)的(de)獨特優勢和(he)應有作用(yong)。

  (二)基本原則

  堅持社會(hui)(hui)化(hua)、市場化(hua)改革方(fang)向。圍繞使市場在資源配置中起決定性作用和更好發(fa)揮政府作用,改革傳統的(de)行(xing)(xing)政化(hua)管理方(fang)式,按照(zhao)去行(xing)(xing)政化(hua)的(de)要求,切斷(duan)行(xing)(xing)政機關和行(xing)(xing)業(ye)協(xie)會(hui)(hui)商會(hui)(hui)之間的(de)利益鏈條(tiao),建立(li)新(xin)型(xing)管理體(ti)制和運(yun)行(xing)(xing)機制,促進和引導行(xing)(xing)業(ye)協(xie)會(hui)(hui)商會(hui)(hui)自主運(yun)行(xing)(xing)、有序競爭、優化(hua)發(fa)展。

  堅持法(fa)制(zhi)化、非營利原則(ze)(ze)。加快(kuai)行(xing)業協(xie)(xie)會商會法(fa)律制(zhi)度建設(she),明確脫鉤后的法(fa)律地位,實現(xian)(xian)依(yi)法(fa)規(gui)范運(yun)行(xing)。建立準(zhun)入和(he)(he)退出機制(zhi),健全綜合監(jian)(jian)管體系。各級政府要明確權力邊界(jie),實現(xian)(xian)權力責任(ren)統一、服(fu)務監(jian)(jian)管并重(zhong)。按照(zhao)非營利原則(ze)(ze)要求,規(gui)范行(xing)業協(xie)(xie)會商會服(fu)務行(xing)為,發揮對會員的行(xing)為引導、規(gui)則(ze)(ze)約束(shu)和(he)(he)權益維(wei)護作用。

  堅持服(fu)務發展(zhan)、釋放市(shi)(shi)場活力(li)。提升行(xing)業(ye)協會(hui)商會(hui)專業(ye)化水平和能(neng)力(li),推動服(fu)務重心從政府轉向(xiang)企業(ye)、行(xing)業(ye)、市(shi)(shi)場。通(tong)過提供指導、咨詢(xun)、信(xin)息等服(fu)務,更好地為企業(ye)、行(xing)業(ye)提供智力(li)支(zhi)撐,規范市(shi)(shi)場主體行(xing)為,引導企業(ye)健康有序發展(zhan),促進產業(ye)提質增(zeng)效升級。

  堅持(chi)試點先(xian)行(xing)、分步(bu)穩(wen)妥推進。在中央和地方分別開展試點,設置必要(yao)的過渡期,積極(ji)探索(suo),總結經驗,完善措施(shi)(shi),逐步(bu)推開。根據行(xing)業協(xie)會商會不同(tong)情(qing)況,因(yin)地因(yin)業因(yin)會逐個(ge)縝(zhen)密(mi)制(zhi)定脫(tuo)鉤實(shi)施(shi)(shi)方案(an),具(ju)體安(an)排(pai)、具(ju)體指(zhi)導(dao)、具(ju)體把握,確保脫(tuo)鉤工作平穩(wen)過渡、有序(xu)推進。

  二、脫鉤(gou)主體和范圍

  脫鉤的主(zhu)體是各級行政機關與其(qi)(qi)(qi)主(zhu)辦(ban)、主(zhu)管(guan)、聯(lian)系、掛靠(kao)的行業協會商會。其(qi)(qi)(qi)他依照(zhao)和參(can)照(zhao)公務員法管(guan)理的單(dan)位與其(qi)(qi)(qi)主(zhu)辦(ban)、主(zhu)管(guan)、聯(lian)系、掛靠(kao)的行業協會商會,參(can)照(zhao)本方案執(zhi)行。

  同時具有(you)以下特征(zheng)的(de)行(xing)業協(xie)會(hui)(hui)商(shang)會(hui)(hui)納入脫鉤(gou)范圍(wei):會(hui)(hui)員主體為(wei)從事(shi)相同性質經濟活動的(de)單(dan)位、同業人員,或同地域的(de)經濟組織;名稱(cheng)以“行(xing)業協(xie)會(hui)(hui)”、“協(xie)會(hui)(hui)”、“商(shang)會(hui)(hui)”、“同業公會(hui)(hui)”、“聯合會(hui)(hui)”、“促進(jin)會(hui)(hui)”等(deng)字(zi)樣(yang)為(wei)后綴;在民政部門登記為(wei)社會(hui)(hui)團體法人。

  個(ge)別承(cheng)擔特殊(shu)職能(neng)的全國性(xing)行(xing)業協會商會,經中央(yang)辦公廳、國務院(yuan)辦公廳批準,另行(xing)制定改革辦法。

  三、脫鉤任(ren)務和措施(shi)

  (一)機(ji)構分離,規范綜合監管關系

  取消行(xing)政(zheng)機關(guan)(包括下屬單位(wei))與行(xing)業協會商會的主辦、主管、聯系和(he)(he)掛靠關(guan)系。行(xing)業協會商會依(yi)法直接登記(ji)和(he)(he)獨立運行(xing)。行(xing)政(zheng)機關(guan)依(yi)據職能對行(xing)業協會商會提供服務并依(yi)法監(jian)管。

  依法(fa)保(bao)障行(xing)(xing)業(ye)(ye)協會(hui)(hui)商會(hui)(hui)獨立平等法(fa)人地位。按照有利(li)于行(xing)(xing)業(ye)(ye)發展和自愿互惠原則,對行(xing)(xing)業(ye)(ye)協會(hui)(hui)商會(hui)(hui)之間(jian)、行(xing)(xing)業(ye)(ye)協會(hui)(hui)商會(hui)(hui)與(yu)其他社(she)會(hui)(hui)組(zu)織(zhi)之間(jian)的代管協管掛靠(kao)關系進行(xing)(xing)調(diao)整,并納(na)入(ru)章程予以規范。鼓勵行(xing)(xing)業(ye)(ye)協會(hui)(hui)商會(hui)(hui)優化整合,提高(gao)服務效(xiao)率和水平。

  調(diao)整行(xing)(xing)(xing)業(ye)協(xie)(xie)會(hui)(hui)商會(hui)(hui)與其代(dai)管(guan)的(de)事(shi)業(ye)單(dan)位(wei)(wei)的(de)關(guan)系。行(xing)(xing)(xing)業(ye)協(xie)(xie)會(hui)(hui)商會(hui)(hui)代(dai)管(guan)的(de)事(shi)業(ye)單(dan)位(wei)(wei),并入(ru)行(xing)(xing)(xing)業(ye)協(xie)(xie)會(hui)(hui)商會(hui)(hui)的(de),注銷事(shi)業(ye)單(dan)位(wei)(wei)法(fa)人(ren)資格,核銷事(shi)業(ye)編制,并入(ru)人(ren)員按照行(xing)(xing)(xing)業(ye)協(xie)(xie)會(hui)(hui)商會(hui)(hui)人(ren)員管(guan)理方式管(guan)理;不能并入(ru)行(xing)(xing)(xing)業(ye)協(xie)(xie)會(hui)(hui)商會(hui)(hui)的(de),應當與行(xing)(xing)(xing)業(ye)協(xie)(xie)會(hui)(hui)商會(hui)(hui)脫鉤,根據業(ye)務關(guan)聯性,在(zai)精簡的(de)基(ji)礎上劃轉到相(xiang)關(guan)行(xing)(xing)(xing)業(ye)管(guan)理部(bu)門管(guan)理,并納(na)入(ru)事(shi)業(ye)單(dan)位(wei)(wei)分(fen)類改(gai)革。

  行(xing)(xing)政機關或事(shi)業單位(wei)與行(xing)(xing)業協(xie)會(hui)商(shang)會(hui)合署辦公的,逐步將機構、人(ren)員和(he)資產分開,行(xing)(xing)政機關或事(shi)業單位(wei)不再(zai)承擔行(xing)(xing)業協(xie)會(hui)商(shang)會(hui)職能。

  (二)職(zhi)能分離,規范行政委托和職(zhi)責分工(gong)關系

  厘(li)清行(xing)(xing)政(zheng)機關與行(xing)(xing)業(ye)協(xie)會(hui)商會(hui)的職(zhi)能(neng)(neng)。剝離行(xing)(xing)業(ye)協(xie)會(hui)商會(hui)現有的行(xing)(xing)政(zheng)職(zhi)能(neng)(neng),法(fa)(fa)律法(fa)(fa)規另有規定的除外。業(ye)務主管單(dan)位對剝離行(xing)(xing)業(ye)協(xie)會(hui)商會(hui)有關行(xing)(xing)政(zheng)職(zhi)能(neng)(neng)提(ti)出具體意見。

  加快轉移(yi)(yi)適合由行(xing)業(ye)協(xie)會商會承(cheng)擔(dan)的(de)職能。行(xing)政機(ji)關(guan)對(dui)適合由行(xing)業(ye)協(xie)會商會承(cheng)擔(dan)的(de)職能,制定清單目錄,按程序移(yi)(yi)交行(xing)業(ye)協(xie)會商會承(cheng)擔(dan),并制定監管(guan)措施、履行(xing)監管(guan)責任。

  (三)資產(chan)財務(wu)分離,規范財產(chan)關(guan)系

  行(xing)業協會商會應執行(xing)民(min)間非營利組織會計制度,單獨(du)建賬、獨(du)立(li)(li)核算。沒(mei)有獨(du)立(li)(li)賬號、與行(xing)政機關(guan)(guan)會計合賬、財務由行(xing)政機關(guan)(guan)代(dai)管或集中管理的(de)行(xing)業協會商會,要設立(li)(li)獨(du)立(li)(li)賬號,單獨(du)核算,實行(xing)獨(du)立(li)(li)財務管理。

  對(dui)原有財(cai)(cai)(cai)政預(yu)算支持(chi)的(de)全國性行(xing)業協(xie)會(hui)商(shang)會(hui),逐步通過(guo)(guo)政府(fu)購買服務等方式支持(chi)其(qi)發展。自2018年(nian)起(qi),取消全國性行(xing)業協(xie)會(hui)商(shang)會(hui)的(de)財(cai)(cai)(cai)政直(zhi)接(jie)撥款,在此之(zhi)前,保(bao)留原有財(cai)(cai)(cai)政撥款經費渠道不變(bian)。為(wei)鼓勵全國性行(xing)業協(xie)會(hui)商(shang)會(hui)加快(kuai)與(yu)行(xing)政機關脫鉤,過(guo)(guo)渡(du)期(qi)內根據(ju)脫鉤年(nian)份,財(cai)(cai)(cai)政直(zhi)接(jie)撥款額度逐年(nian)遞(di)減(jian)。地方性行(xing)業協(xie)會(hui)商(shang)會(hui)的(de)財(cai)(cai)(cai)政撥款過(guo)(guo)渡(du)期(qi)和(he)過(guo)(guo)渡(du)辦法,由(you)各地自行(xing)確(que)定,但過(guo)(guo)渡(du)期(qi)不得(de)超(chao)過(guo)(guo)2017年(nian)底。用(yong)于安置歷(li)次(ci)政府(fu)機構(gou)改革分流(liu)人員的(de)財(cai)(cai)(cai)政資金,仍(reng)按原規定執行(xing)。

  按(an)照財(cai)政部(bu)門、機(ji)(ji)關(guan)事務主(zhu)管(guan)部(bu)門統(tong)一部(bu)署(shu)和(he)有(you)關(guan)規定,各業務主(zhu)管(guan)單位對其主(zhu)管(guan)的行業協(xie)(xie)會(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)財(cai)務資(zi)產(chan)狀況進行全面(mian)摸底和(he)清查登記(ji),厘清財(cai)產(chan)歸屬(shu)。財(cai)政部(bu)門會(hui)(hui)(hui)(hui)同(tong)機(ji)(ji)關(guan)事務主(zhu)管(guan)部(bu)門按(an)照所有(you)權、使用(yong)權相(xiang)分離(li)的原(yuan)則,制定行業協(xie)(xie)會(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)使用(yong)國(guo)有(you)資(zi)產(chan)(包括無形資(zi)產(chan))管(guan)理辦法,確(que)保國(guo)有(you)資(zi)產(chan)不流失,同(tong)時確(que)保行業協(xie)(xie)會(hui)(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)(hui)的正常運(yun)行和(he)發(fa)展。

  行(xing)業協會商(shang)會占用(yong)(yong)的(de)行(xing)政辦(ban)(ban)(ban)公(gong)(gong)用(yong)(yong)房,超出規定面(mian)積標準的(de)部分限期清(qing)理(li)騰退;符合規定面(mian)積標準的(de)部分暫由行(xing)業協會商(shang)會使(shi)用(yong)(yong),2017年底前按《中共中央辦(ban)(ban)(ban)公(gong)(gong)廳(ting)、國(guo)務(wu)院辦(ban)(ban)(ban)公(gong)(gong)廳(ting)關于(yu)黨政機(ji)(ji)關停止新(xin)建樓堂館(guan)所和清(qing)理(li)辦(ban)(ban)(ban)公(gong)(gong)用(yong)(yong)房的(de)通知》及有(you)關規定清(qing)理(li)騰退,原(yuan)則(ze)上(shang)應實(shi)現辦(ban)(ban)(ban)公(gong)(gong)場所獨立。具體辦(ban)(ban)(ban)法由機(ji)(ji)關事務(wu)主(zhu)管(guan)部門會同有(you)關部門制定。

  (四)人(ren)(ren)員管理分離(li),規范用人(ren)(ren)關系

  行業協會商會具有人事(shi)自(zi)(zi)主權(quan),在人員管理上與原主辦、主管、聯(lian)系和掛靠(kao)單(dan)位脫鉤,依法依規建立規范用(yong)人制度,逐步實行依章程(cheng)自(zi)(zi)主選人用(yong)人。

  行(xing)政(zheng)機關不得推薦(jian)、安排在(zai)職(zhi)(zhi)和(he)退(tui)(tui)(離)休(xiu)公務員到(dao)行(xing)業協會(hui)商(shang)(shang)會(hui)任職(zhi)(zhi)兼職(zhi)(zhi)。現職(zhi)(zhi)和(he)不擔任現職(zhi)(zhi)但(dan)未(wei)辦理退(tui)(tui)(離)休(xiu)手續的黨(dang)政(zheng)領(ling)導(dao)干(gan)部及在(zai)職(zhi)(zhi)工作(zuo)人員,不得在(zai)行(xing)業協會(hui)商(shang)(shang)會(hui)兼任職(zhi)(zhi)務。領(ling)導(dao)干(gan)部退(tui)(tui)(離)休(xiu)后(hou)三年內一(yi)般(ban)不得到(dao)行(xing)業協會(hui)商(shang)(shang)會(hui)兼職(zhi)(zhi),個別確屬工作(zuo)特殊需要兼職(zhi)(zhi)的,應(ying)當按(an)照干(gan)部管理權限(xian)審(shen)批(pi);退(tui)(tui)(離)休(xiu)三年后(hou)到(dao)行(xing)業協會(hui)商(shang)(shang)會(hui)兼職(zhi)(zhi),須按(an)干(gan)部管理權限(xian)審(shen)批(pi)或備案(an)后(hou)方(fang)可兼職(zhi)(zhi)。

  對已在行業(ye)(ye)(ye)協(xie)會商(shang)會中任職(zhi)(zhi)、兼職(zhi)(zhi)的公(gong)(gong)務員(yuan),按相關規(gui)定進行一次(ci)性清理。任職(zhi)(zhi)的在職(zhi)(zhi)公(gong)(gong)務員(yuan),脫鉤后自(zi)愿(yuan)選(xuan)擇(ze)去(qu)(qu)留(liu)(liu):退出行業(ye)(ye)(ye)協(xie)會商(shang)會工作的,由(you)所屬行政機(ji)關妥善安置(zhi);本人自(zi)愿(yuan)繼續留(liu)(liu)在行業(ye)(ye)(ye)協(xie)會商(shang)會工作的,退出公(gong)(gong)務員(yuan)管理,不再(zai)保留(liu)(liu)公(gong)(gong)務員(yuan)身(shen)份。在行業(ye)(ye)(ye)協(xie)會商(shang)會兼職(zhi)(zhi)的公(gong)(gong)務員(yuan),要(yao)限(xian)期(qi)辭去(qu)(qu)兼任職(zhi)(zhi)務。

  行業(ye)(ye)協(xie)會商會全面實(shi)行勞動合同制度(du),與工作(zuo)(zuo)人(ren)員簽訂勞動合同,依法(fa)保障工作(zuo)(zuo)人(ren)員合法(fa)權益。工作(zuo)(zuo)人(ren)員的(de)工資,由(you)行業(ye)(ye)協(xie)會商會按(an)照(zhao)國家有關法(fa)律(lv)、法(fa)規和政策(ce)確定(ding)(ding)。行業(ye)(ye)協(xie)會商會及(ji)其工作(zuo)(zuo)人(ren)員按(an)規定(ding)(ding)參加基本養老、基本醫療(liao)等(deng)社會保險和繳存住房公積金。

  行(xing)業協會商會與行(xing)政機關脫(tuo)鉤(gou)后,使用的事(shi)業編(bian)制相(xiang)應核銷。現有(you)事(shi)業人(ren)員(yuan)按國家有(you)關規定參加(jia)機關事(shi)業單位養老保險(xian)。歷次政府機構改(gai)革分流人(ren)員(yuan)仍執行(xing)原定政策。

  (五(wu))黨建、外事等事項(xiang)分(fen)離,規范管理關(guan)系(xi)

  行(xing)(xing)業(ye)(ye)協(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)的(de)黨(dang)(dang)建(jian)(jian)、外事(shi)(shi)、人力(li)資源(yuan)服務(wu)等事(shi)(shi)項(xiang)與原主辦(ban)(ban)、主管(guan)、聯系(xi)和(he)掛靠(kao)單(dan)位(wei)(wei)脫鉤(gou)。全國(guo)(guo)(guo)性(xing)行(xing)(xing)業(ye)(ye)協(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)與行(xing)(xing)政機(ji)(ji)關(guan)(guan)脫鉤(gou)后的(de)黨(dang)(dang)建(jian)(jian)工(gong)(gong)作(zuo),按(an)(an)照(zhao)原業(ye)(ye)務(wu)主管(guan)單(dan)位(wei)(wei)黨(dang)(dang)的(de)關(guan)(guan)系(xi)歸口分別由(you)中央(yang)直屬機(ji)(ji)關(guan)(guan)工(gong)(gong)委、中央(yang)國(guo)(guo)(guo)家機(ji)(ji)關(guan)(guan)工(gong)(gong)委、國(guo)(guo)(guo)務(wu)院國(guo)(guo)(guo)資委黨(dang)(dang)委領導(dao)。地(di)方(fang)行(xing)(xing)業(ye)(ye)協(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)與行(xing)(xing)政機(ji)(ji)關(guan)(guan)脫鉤(gou)后的(de)黨(dang)(dang)建(jian)(jian)工(gong)(gong)作(zuo),依托各地(di)黨(dang)(dang)委組織(zhi)(zhi)部(bu)門(men)和(he)民(min)政部(bu)門(men)建(jian)(jian)立(li)社會(hui)(hui)(hui)組織(zhi)(zhi)黨(dang)(dang)建(jian)(jian)工(gong)(gong)作(zuo)機(ji)(ji)構(gou)統一(yi)領導(dao);已(yi)經建(jian)(jian)立(li)非(fei)公(gong)有(you)(you)(you)制企業(ye)(ye)黨(dang)(dang)建(jian)(jian)工(gong)(gong)作(zuo)機(ji)(ji)構(gou)的(de),可(ke)依托組織(zhi)(zhi)部(bu)門(men)將其(qi)與社會(hui)(hui)(hui)組織(zhi)(zhi)黨(dang)(dang)建(jian)(jian)工(gong)(gong)作(zuo)機(ji)(ji)構(gou)整合為一(yi)個機(ji)(ji)構(gou)。行(xing)(xing)業(ye)(ye)協(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)脫鉤(gou)后,外事(shi)(shi)工(gong)(gong)作(zuo)由(you)住(zhu)所(suo)地(di)省(區(qu)、市(shi))人民(min)政府(fu)按(an)(an)中央(yang)有(you)(you)(you)關(guan)(guan)外事(shi)(shi)管(guan)理(li)規定(ding)執行(xing)(xing),不再經原主辦(ban)(ban)、主管(guan)、聯系(xi)和(he)掛靠(kao)單(dan)位(wei)(wei)審(shen)批。行(xing)(xing)業(ye)(ye)協(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)主管(guan)和(he)主辦(ban)(ban)的(de)新聞出版單(dan)位(wei)(wei)的(de)業(ye)(ye)務(wu)管(guan)理(li),按(an)(an)照(zhao)文(wen)化體制改革相關(guan)(guan)要求和(he)新聞出版行(xing)(xing)政管(guan)理(li)部(bu)門(men)有(you)(you)(you)關(guan)(guan)規定(ding)執行(xing)(xing)。人力(li)資源(yuan)服務(wu)等事(shi)(shi)項(xiang)由(you)行(xing)(xing)業(ye)(ye)協(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)住(zhu)所(suo)地(di)有(you)(you)(you)關(guan)(guan)部(bu)門(men)按(an)(an)職能(neng)分工(gong)(gong)承擔。

  四、配套政策(ce)

  (一)完善支持政策

  制定有針對(dui)性的(de)(de)扶持(chi)引導(dao)政(zheng)(zheng)策,加(jia)(jia)強分類指導(dao)。完善政(zheng)(zheng)府(fu)(fu)購(gou)買服務(wu)機制,支(zhi)持(chi)行業協(xie)會(hui)商會(hui)轉型發展。鼓勵各有關(guan)(guan)部門按照(zhao)《國務(wu)院辦公廳關(guan)(guan)于政(zheng)(zheng)府(fu)(fu)向社(she)會(hui)力量購(gou)買服務(wu)的(de)(de)指導(dao)意見》要求(qiu),向符合條件的(de)(de)行業協(xie)會(hui)商會(hui)和其他(ta)社(she)會(hui)力量購(gou)買服務(wu),及時公布(bu)購(gou)買服務(wu)事(shi)項和相關(guan)(guan)信息(xi),加(jia)(jia)強績效管理。

  完善行(xing)業協會(hui)(hui)商會(hui)(hui)價格政(zheng)策,落(luo)實(shi)有關稅(shui)(shui)收政(zheng)策。按照(zhao)行(xing)政(zheng)事業性(xing)收費(fei)管(guan)理的(de)有關規定,規范行(xing)業協會(hui)(hui)商會(hui)(hui)承接政(zheng)府委托(tuo)的(de)行(xing)政(zheng)事業性(xing)收費(fei)事項。對符合(he)條件的(de)非營利組織(zhi)落(luo)實(shi)企業所得稅(shui)(shui)優惠政(zheng)策。

  鼓勵行(xing)(xing)業協(xie)(xie)會商(shang)會參與制定相關立法、政府(fu)規劃、公共政策、行(xing)(xing)業標準和(he)行(xing)(xing)業數據統計等事務(wu)。有關部門要充分發揮行(xing)(xing)業協(xie)(xie)會商(shang)會在行(xing)(xing)業指(zhi)南制定、行(xing)(xing)業人才培養、共性技術平(ping)臺(tai)建設、第三(san)方咨詢評估等方面(mian)作(zuo)用,完善(shan)對(dui)行(xing)(xing)業協(xie)(xie)會商(shang)會服務(wu)創新能(neng)力建設的支持機制。

  建(jian)立信(xin)(xin)息資源共享(xiang)機制。全(quan)國(guo)性(xing)行(xing)(xing)業(ye)協會商會的(de)有關行(xing)(xing)業(ye)統計數(shu)(shu)據(ju),按原規定(ding)(ding)報(bao)送國(guo)家統計局。行(xing)(xing)業(ye)協會商會應(ying)按原渠道向行(xing)(xing)業(ye)管理(li)部(bu)門報(bao)送相(xiang)關行(xing)(xing)業(ye)數(shu)(shu)據(ju)和(he)信(xin)(xin)息。有關職能部(bu)門要建(jian)立行(xing)(xing)業(ye)公共信(xin)(xin)息交匯平臺,整合全(quan)國(guo)性(xing)行(xing)(xing)業(ye)協會商會的(de)有關數(shu)(shu)據(ju),為(wei)政府制定(ding)(ding)和(he)實(shi)施(shi)相(xiang)關政策提供(gong)信(xin)(xin)息服務,為(wei)行(xing)(xing)業(ye)協會商會提供(gong)必(bi)要的(de)行(xing)(xing)業(ye)信(xin)(xin)息和(he)數(shu)(shu)據(ju)。

  支持行(xing)(xing)業(ye)(ye)協(xie)(xie)會(hui)(hui)商(shang)會(hui)(hui)在進(jin)出口貿(mao)易(yi)和對外經濟交流、企業(ye)(ye)“走出去”、應對貿(mao)易(yi)摩擦(ca)等事務(wu)(wu)中(zhong),發揮協(xie)(xie)調、指導、咨(zi)詢、服(fu)務(wu)(wu)作用。鼓勵行(xing)(xing)業(ye)(ye)協(xie)(xie)會(hui)(hui)商(shang)會(hui)(hui)參與協(xie)(xie)助政(zheng)府部門多雙邊經貿(mao)談判工作,提(ti)供相關咨(zi)詢和協(xie)(xie)調服(fu)務(wu)(wu)。鼓勵行(xing)(xing)業(ye)(ye)協(xie)(xie)會(hui)(hui)商(shang)會(hui)(hui)積極搭建促進(jin)對外貿(mao)易(yi)和投(tou)資(zi)等服(fu)務(wu)(wu)平臺,幫(bang)助企業(ye)(ye)開(kai)拓國(guo)際市場。

  (二)完善綜合監管(guan)體制

  加(jia)強法律(lv)法規制度建(jian)設。加(jia)快推進(jin)行(xing)業(ye)(ye)協(xie)會(hui)商(shang)會(hui)立(li)法工作(zuo)。行(xing)業(ye)(ye)協(xie)會(hui)商(shang)會(hui)脫(tuo)(tuo)鉤(gou)后,按(an)程序(xu)修(xiu)改章(zhang)程并報民政部(bu)門備案。健全行(xing)業(ye)(ye)協(xie)會(hui)商(shang)會(hui)退出機(ji)制,在實施脫(tuo)(tuo)鉤(gou)中對職能(neng)不(bu)清、業(ye)(ye)務(wu)開展不(bu)正常、不(bu)適應(ying)經濟社(she)會(hui)發展的行(xing)業(ye)(ye)協(xie)會(hui)商(shang)會(hui)依法予以注銷。鼓勵和促進(jin)行(xing)業(ye)(ye)協(xie)會(hui)商(shang)會(hui)間(jian)公平(ping)有序(xu)競爭。

  國(guo)家發展(zhan)改革(ge)委(wei)、民政(zheng)部(bu)會(hui)同(tong)(tong)中央(yang)組(zu)(zu)(zu)織(zhi)部(bu)、中央(yang)編辦、中央(yang)直(zhi)屬機(ji)關(guan)工(gong)(gong)(gong)委(wei)、中央(yang)國(guo)家機(ji)關(guan)工(gong)(gong)(gong)委(wei)、外交部(bu)、工(gong)(gong)(gong)業和(he)信息化部(bu)、財政(zheng)部(bu)、人力資源社會(hui)保障(zhang)部(bu)、商(shang)務(wu)部(bu)、審計署、國(guo)務(wu)院(yuan)國(guo)資委(wei)、國(guo)管(guan)局(ju)、全國(guo)工(gong)(gong)(gong)商(shang)聯(lian)(lian),成立行業協(xie)會(hui)商(shang)會(hui)與行政(zheng)機(ji)關(guan)脫(tuo)鉤聯(lian)(lian)合工(gong)(gong)(gong)作組(zu)(zu)(zu)(以下簡稱聯(lian)(lian)合工(gong)(gong)(gong)作組(zu)(zu)(zu)),負(fu)責組(zu)(zu)(zu)織(zhi)實施本(ben)方案,推進全國(guo)性行業協(xie)會(hui)商(shang)會(hui)脫(tuo)鉤工(gong)(gong)(gong)作,指導(dao)和(he)督促各地開展(zhan)脫(tuo)鉤工(gong)(gong)(gong)作。聯(lian)(lian)合工(gong)(gong)(gong)作組(zu)(zu)(zu)由國(guo)務(wu)院(yuan)領導(dao)同(tong)(tong)志牽頭,辦公室設(she)在國(guo)家發展(zhan)改革(ge)委(wei)。各地建立相應領導(dao)機(ji)制和(he)工(gong)(gong)(gong)作組(zu)(zu)(zu),制定本(ben)地區脫(tuo)鉤方案,負(fu)責推進本(ben)地區脫(tuo)鉤工(gong)(gong)(gong)作。

  (二)明確責(ze)任(ren)分工

  各(ge)相關(guan)職(zhi)能部門按照本方案和職(zhi)能分工(gong),落(luo)實(shi)相關(guan)政策和措施。各(ge)級發展改革、民政部門負(fu)責統籌協(xie)調、督(du)促檢查脫鉤工(gong)作。審(shen)計(ji)部門負(fu)責對資(zi)產清(qing)查結果進行抽查監督(du),審(shen)計(ji)脫鉤過(guo)程(cheng)中財政資(zi)金使用情況。各(ge)業(ye)務主(zhu)管單(dan)位(wei)負(fu)責逐個制定行業(ye)協(xie)會商會脫鉤實(shi)施方案,落(luo)實(shi)各(ge)項工(gong)作,并向社會公開(kai)。

  本方案印發后一個月內,有(you)關(guan)(guan)(guan)部(bu)(bu)(bu)門(men)(men)分別出(chu)(chu)臺相關(guan)(guan)(guan)配套(tao)文件:中(zhong)央(yang)(yang)組(zu)織部(bu)(bu)(bu)會(hui)(hui)(hui)(hui)同中(zhong)央(yang)(yang)直屬機(ji)(ji)關(guan)(guan)(guan)工(gong)(gong)委(wei)(wei)(wei)、中(zhong)央(yang)(yang)國(guo)家機(ji)(ji)關(guan)(guan)(guan)工(gong)(gong)委(wei)(wei)(wei)、國(guo)務院(yuan)國(guo)資(zi)委(wei)(wei)(wei)黨(dang)委(wei)(wei)(wei)制(zhi)定(ding)(ding)關(guan)(guan)(guan)于(yu)全(quan)(quan)國(guo)性行(xing)(xing)業(ye)協(xie)會(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)與行(xing)(xing)政(zheng)(zheng)機(ji)(ji)關(guan)(guan)(guan)脫鉤(gou)后黨(dang)建工(gong)(gong)作(zuo)管理(li)體(ti)(ti)制(zhi)調整(zheng)(zheng)的(de)(de)(de)實(shi)施(shi)辦法(fa),明確(que)黨(dang)的(de)(de)(de)思想、組(zu)織、作(zuo)風、反(fan)腐倡(chang)廉(lian)和制(zhi)度建設(she)的(de)(de)(de)具(ju)體(ti)(ti)任務,切實(shi)加強黨(dang)對(dui)行(xing)(xing)業(ye)協(xie)會(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)黨(dang)建工(gong)(gong)作(zuo)的(de)(de)(de)領導;中(zhong)央(yang)(yang)編(bian)辦會(hui)(hui)(hui)(hui)同國(guo)家發展(zhan)改革委(wei)(wei)(wei)、工(gong)(gong)業(ye)和信(xin)息(xi)化部(bu)(bu)(bu)、財(cai)政(zheng)(zheng)部(bu)(bu)(bu)、人(ren)力資(zi)源(yuan)社會(hui)(hui)(hui)(hui)保(bao)障部(bu)(bu)(bu)、商務部(bu)(bu)(bu)、國(guo)務院(yuan)國(guo)資(zi)委(wei)(wei)(wei)等(deng)部(bu)(bu)(bu)門(men)(men)提出(chu)(chu)關(guan)(guan)(guan)于(yu)行(xing)(xing)業(ye)協(xie)會(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)與行(xing)(xing)政(zheng)(zheng)機(ji)(ji)關(guan)(guan)(guan)脫鉤(gou)涉及事(shi)業(ye)單位機(ji)(ji)構編(bian)制(zhi)調整(zheng)(zheng)的(de)(de)(de)意見;外交部(bu)(bu)(bu)提出(chu)(chu)相關(guan)(guan)(guan)外事(shi)管理(li)工(gong)(gong)作(zuo)政(zheng)(zheng)策措施(shi);國(guo)家發展(zhan)改革委(wei)(wei)(wei)牽頭(tou)制(zhi)定(ding)(ding)行(xing)(xing)業(ye)公共信(xin)息(xi)平臺建設(she)方案;民政(zheng)(zheng)部(bu)(bu)(bu)牽頭(tou)制(zhi)定(ding)(ding)全(quan)(quan)國(guo)性行(xing)(xing)業(ye)協(xie)會(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)主要(yao)負責(ze)人(ren)任職管理(li)辦法(fa);財(cai)政(zheng)(zheng)部(bu)(bu)(bu)會(hui)(hui)(hui)(hui)同國(guo)管局(ju)(ju)、中(zhong)直管理(li)局(ju)(ju)等(deng)有(you)關(guan)(guan)(guan)部(bu)(bu)(bu)門(men)(men)制(zhi)定(ding)(ding)行(xing)(xing)業(ye)協(xie)會(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)資(zi)產(chan)清(qing)(qing)查和國(guo)有(you)資(zi)產(chan)管理(li)規定(ding)(ding),財(cai)政(zheng)(zheng)部(bu)(bu)(bu)提出(chu)(chu)逐(zhu)步(bu)取(qu)消財(cai)政(zheng)(zheng)撥款的(de)(de)(de)具(ju)體(ti)(ti)操作(zuo)辦法(fa),財(cai)政(zheng)(zheng)部(bu)(bu)(bu)會(hui)(hui)(hui)(hui)同國(guo)家發展(zhan)改革委(wei)(wei)(wei)等(deng)部(bu)(bu)(bu)門(men)(men)提出(chu)(chu)購買(mai)行(xing)(xing)業(ye)協(xie)會(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)服務的(de)(de)(de)具(ju)體(ti)(ti)措施(shi);國(guo)管局(ju)(ju)、中(zhong)直管理(li)局(ju)(ju)會(hui)(hui)(hui)(hui)同有(you)關(guan)(guan)(guan)部(bu)(bu)(bu)門(men)(men)制(zhi)定(ding)(ding)清(qing)(qing)理(li)騰(teng)退全(quan)(quan)國(guo)性行(xing)(xing)業(ye)協(xie)會(hui)(hui)(hui)(hui)商會(hui)(hui)(hui)(hui)占用行(xing)(xing)政(zheng)(zheng)辦公用房的(de)(de)(de)具(ju)體(ti)(ti)辦法(fa)。

  為適應行業協會商(shang)會脫鉤后的新體(ti)制(zhi)(zhi)新要求(qiu),國(guo)家(jia)發展改革委、民政部會同(tong)有關部門制(zhi)(zhi)定綜合監管辦法。

  (三)穩妥開展(zhan)試點

  全(quan)國性行(xing)業(ye)協(xie)(xie)(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)脫(tuo)鉤試(shi)(shi)(shi)點(dian)(dian)工作由(you)民(min)政(zheng)部牽頭負(fu)責(ze),2015年(nian)(nian)下半(ban)年(nian)(nian)開始第(di)一批(pi)(pi)試(shi)(shi)(shi)點(dian)(dian),2016年(nian)(nian)總(zong)結經驗、擴大(da)試(shi)(shi)(shi)點(dian)(dian),2017年(nian)(nian)在更大(da)范圍試(shi)(shi)(shi)點(dian)(dian),通過試(shi)(shi)(shi)點(dian)(dian)完(wan)善相應的體制機(ji)制后(hou)全(quan)面推開。按(an)照(zhao)兼顧不同類(lei)型、行(xing)業(ye)和(he)部門(men)的原(yuan)則,第(di)一批(pi)(pi)選(xuan)擇100個左(zuo)右(you)全(quan)國性行(xing)業(ye)協(xie)(xie)(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)開展脫(tuo)鉤試(shi)(shi)(shi)點(dian)(dian)。各業(ye)務主(zhu)管單位于2015年(nian)(nian)7月底(di)前(qian)(qian)將推薦試(shi)(shi)(shi)點(dian)(dian)名單報送(song)民(min)政(zheng)部,并(bing)逐個制定(ding)試(shi)(shi)(shi)點(dian)(dian)行(xing)業(ye)協(xie)(xie)(xie)會(hui)(hui)(hui)商(shang)會(hui)(hui)(hui)脫(tuo)鉤實施(shi)方案(an)。方案(an)報經民(min)政(zheng)部核準、聯合工作組批(pi)(pi)復后(hou)實施(shi),其中須有關(guan)部門(men)批(pi)(pi)準的事(shi)項,按(an)管理(li)權(quan)限和(he)職能分別報批(pi)(pi)。各試(shi)(shi)(shi)點(dian)(dian)單位要在2016年(nian)(nian)6月底(di)前(qian)(qian)完(wan)成(cheng)第(di)一批(pi)(pi)試(shi)(shi)(shi)點(dian)(dian),由(you)聯合工作組對試(shi)(shi)(shi)點(dian)(dian)成(cheng)效(xiao)進行(xing)評估(gu)并(bing)認真總(zong)結經驗,完(wan)善配套政(zheng)策。

  地方(fang)行業協會(hui)商會(hui)脫鉤試點(dian)工(gong)(gong)作由各省(區(qu)、市)工(gong)(gong)作組負責。各省(區(qu)、市)同步(bu)開展本地區(qu)脫鉤試點(dian)工(gong)(gong)作,首先(xian)選(xuan)擇(ze)幾(ji)個省一級協會(hui)開展試點(dian),試點(dian)方(fang)案報(bao)經民政部核準、聯合工(gong)(gong)作組批(pi)復后實施。各地要在(zai)2016年(nian)底前(qian)完成第一批(pi)試點(dian)和評(ping)(ping)估,并將評(ping)(ping)估結(jie)果報(bao)聯合工(gong)(gong)作組。在(zai)認真總結(jie)經驗的(de)基礎上,完善試點(dian)政策(ce),逐步(bu)擴大試點(dian)范圍(wei),穩妥審(shen)慎推開。

  (四)精心組(zu)織實(shi)施

  脫(tuo)鉤工(gong)(gong)作涉及面廣、政策性強(qiang)(qiang)、社會(hui)關注度高(gao),各(ge)地區(qu)、各(ge)有關部門(men)和(he)行業協會(hui)商會(hui)要(yao)(yao)高(gao)度重視(shi),嚴明紀律,做好(hao)風險預案,確保如(ru)期完成脫(tuo)鉤任務。要(yao)(yao)嚴格按照本方案要(yao)(yao)求推進脫(tuo)鉤工(gong)(gong)作,規范工(gong)(gong)作程序,建(jian)立考(kao)核機制,確保工(gong)(gong)作有序開展。要(yao)(yao)加強(qiang)(qiang)輿論引導(dao)和(he)政策解讀(du),形成良(liang)好(hao)輿論氛(fen)圍。脫(tuo)鉤工(gong)(gong)作中遇有重要(yao)(yao)情況和(he)問題,要(yao)(yao)及時向聯合工(gong)(gong)作組報告。

  各(ge)地區、各(ge)部門要大力支持行(xing)(xing)業協(xie)(xie)會(hui)(hui)(hui)商(shang)(shang)(shang)(shang)會(hui)(hui)(hui)發(fa)展,優化發(fa)展環(huan)境(jing),改進工作(zuo)方式,構建(jian)與(yu)行(xing)(xing)業協(xie)(xie)會(hui)(hui)(hui)商(shang)(shang)(shang)(shang)會(hui)(hui)(hui)新(xin)(xin)型(xing)合(he)作(zuo)關(guan)系;建(jian)立和(he)(he)完(wan)(wan)善與(yu)行(xing)(xing)業協(xie)(xie)會(hui)(hui)(hui)商(shang)(shang)(shang)(shang)會(hui)(hui)(hui)協(xie)(xie)商(shang)(shang)(shang)(shang)機制,在研究(jiu)重大問題和(he)(he)制定相關(guan)法律(lv)法規(gui)、規(gui)劃、政策時應主動聽取相關(guan)行(xing)(xing)業協(xie)(xie)會(hui)(hui)(hui)商(shang)(shang)(shang)(shang)會(hui)(hui)(hui)意見;加(jia)強對行(xing)(xing)業協(xie)(xie)會(hui)(hui)(hui)商(shang)(shang)(shang)(shang)會(hui)(hui)(hui)的指導(dao)和(he)(he)支持,及(ji)時研究(jiu)解(jie)決行(xing)(xing)業協(xie)(xie)會(hui)(hui)(hui)商(shang)(shang)(shang)(shang)會(hui)(hui)(hui)改革發(fa)展中的困(kun)難和(he)(he)問題。行(xing)(xing)業協(xie)(xie)會(hui)(hui)(hui)商(shang)(shang)(shang)(shang)會(hui)(hui)(hui)要加(jia)快轉型(xing),努(nu)力適應新(xin)(xin)常態(tai)、新(xin)(xin)規(gui)則、新(xin)(xin)要求(qiu),完(wan)(wan)善治(zhi)(zhi)理結構,規(gui)范(fan)自(zi)(zi)身行(xing)(xing)為,提升專(zhuan)業服務水平,強化行(xing)(xing)業自(zi)(zi)律(lv),引導(dao)企業規(gui)范(fan)經營,積極(ji)反(fan)映會(hui)(hui)(hui)員訴求(qiu),維護會(hui)(hui)(hui)員合(he)法權益,真(zhen)正(zheng)成為依法自(zi)(zi)治(zhi)(zhi)的現代社會(hui)(hui)(hui)組(zu)織。

  自本方(fang)案印發之日起,新設立的行(xing)業協會商(shang)會,按本方(fang)案要求執行(xing)。
